Switching Job after 180 days

I have my I-485 filed on Jan 2002. I got the EAD and done FP sometimes March 2002.

1. My client has given me an offer of full time job and I am little confused whether to take it up now or to wait till I get the I-485 approval. The main reason behind this is, my title in LCA is Network Manager and client wouldn't be offering the same title. But their lawer evaluated my job description on LCA and confirmed that both the job descriptions are matching. So they can easily port my I 485 application. So I am wondering... what should I do?

2. If I need to join there, what will be precautions I should take in order to make sure that my I485 application is still valid?

3. Any idea how long it is going to take to get the final approval on I-485. My RD jan 2002.

Thanks in advance.

1. Jump now.
2. Use EAD, get letter from employer that a job will still be available after your GC is approved with the same responsibilities. You might get a RFE which you reply using the above said letter. Also look out for new regulations from INS regarding this (whenever it comes, that is...)
3. What is your service center? See processing times in most of the web sites.

Thanks Jaxen.

>>look out for new regulations from INS regarding this (whenever it comes, that is...)

Where can I find this... could you please provide the URL if something like that exists

Secondly, is it necessary to inform INS when I switch my employer? I mean..do I need to file AC21?

Thanks again.

----- No AC21 Final Regulations published till date.

-------- If you do not inform INS or submit a new employer letter, do you think they get dreams that you changed employer and want to use AC21?

Akara,
Regarding your second question, INS has not issued any directives. So,I disagree with Avtaar about informing INS. I certainly agree that INS does not dream about AC-21 but INS has not promulgated any rules that forces you to write a letter to them. I don't think there is any penalty if you don't inform them. So, keep quiet and if you get approval well and good. If they issue RFE about employment at that time, mention that you are planning to use AC-21.

thanks,
raju

my 2cents

Dear Raju,
1. the person is changing the employer who sponsered for GC
2. INS has not forced but if he does not inform INS then his I-485 will be approved for OLD employer becase INS has not recieved any letter regarding change in Intent or he/she joined new employer, in this case if he does not inform INS to use AC21 before his I-485 gets approved, then he has to work for the ORIGNAL employer after stamping GC
3 INS may not send RFE to him if they find every thing in order or dont need any more document.
Why the INS will ask if one has changed employer? it is the duty of applicant to inform if changed employer, if want to work with the old employer after approval then no need

Chat User : Does one need to inform INS about a job change? I have changed my job using AC21 law.

Attorney Murthy : The June 2001 AC21 Interim Guidance Memo from the INS suggests notifying the INS upon changing employers. There is a risk if one notifies the INS prior to 180 days since the I-485 has been filed. It is safest to notify the INS immediately after the 180-day timeframe to ensure that if the INS approves the case, that it is under AC21 law

Jaxen,

Please answer this...
I got a doubt here from your post

Can someone send a letter to INS, like that what u mentioned previously, like from the old emplyer, even if he had used AC21 and joined another company using EAD?

Thanks
