I have a H1 B, which expired in February this year. My company, filed for a renewal in early January, but the renewal is still under process.
My company is not doing too well - and I suspect layoffs imminent.
Scenarios
A.
If I find a job before the layoffs come, Can I switch (while the transfer is in progress), and can the new company apply for H1 transfer (transfer, and not apply for a 'new' visa) for me?
B.
If I donot find a job before I get layoff(God forbid
), would I be 'out-of-status' immediately? For how long can I then be in USA, and how soon should I get a job to allow the new company to apply for a H1 transfer (instead of a new one)?
