Suing USCIS?

Hi Folks,
Many of you have noticed that USCIS sends an approval email for EB1 EA and later send an RFE. Can this be a case to sue for giving first Approval and later RFE which is in my case.

Any comments/suggestions?
 
Is the RFE for your EB1 EA petition or for your I-485 adjustment application? I'm not sure I understand...
 
An I-140 cannot be approved based on a mistake (whatever happened with that email there). Reply to the RFE and see what happens. If you get a denial, you can mention it in your appeal.

emails fron USCIS are only for information and they are not official documents.
There are cases where no emails were received but approval notices were recieved in mail.
Better grounds will be the conflicting information received from different IO if you can prove that.
