Hi,

My company applied for my LC and I-140 together before 15th July using a pre-approved labor (LC substitution).

Questions:
1. How long does it typically take for the I-140 receipt to reach my company lawyers?
2. If the I-140 receipt does not arrive before August 17, will I not be able to apply for I-485?

Folks, please share your thoughts on this.

Hey Vinsin,

I am in the same boat. I have just gone through the i-485 form and it doesn't states that receipt for I-140 is required. Only thing needed is Employment letter from your employer that the job for which I-140 was filed is still available to you. i will talk to my lawyer tomorrow and update you. Please do let me know if you find aything as well.

-----------------if the your Fee check for I-140 is cashed by USCIS then back of that check is your reciept #, go to USCIS online status check punch the reciept# and take the printout and attach with I-485 and also explain the situation on cover letter.

A cover letter deswicribing the situation and a proof of delivery is sufficient for filing I-485. Proof being the tracking receipt that it was delivered and accepted.
Copy of the cashed check is even better proof.

So, It can be filed WITHOUT I-140 receipt notice.

Neekat, could you please tell me the source of your information? My employer said ''we will wait until Aug 10 for the receipt and then file and see what happens. If they reject it then we will have to fight". Your solution seems to be more constructive ;) So, thanks.
