Studying on H1B?

Hello,

I have been using my OPT for 3 months now and my employer wishes to sponsor me for a H1B. However, I'd like to take classes next year and complete a degree.

Is it legal for me to take classes while on a H1B and if so, how do I do it and where do I start.

As long as you maintain the conditions of your H1, mainly full time work (40 Hr/week), then there is no problem. You can keep studying part time.

Do I apply to the program as an international student and request a I-20?
What status do I apply under?

Your status will remain H1B. You will be considered a foriegn student but you will not need a F1 visa. I am not too familiar with I-20, but I think you do not need that. Search in this forum and you will find other threads where H1B people have discussed going to school. You will apply under foreign student, i.e you will have to pay out of state tution and need to clear TOEFL etc., which I think you already have as you are on OPT currently.

As long as the study is part-time and you are maintaining full-time job status, you should be ok.
