Hi,
My husband and I, are working on my GC papers since the past few months. Each time I find something that I didnt realize we needed before, so finally my package is coming together. However I still have some haunting questions, which USCIS.gov doesnt explain much in detail about. So I am turning on the experts who have already gone thru this process. These are my following questions:

1. For my I-485 do you need the original marriage certificate? or photocopy?

2. Does my husband need Employment verification letter and paystubs and W2 for his I-130?

3. I dont intend to travel anywhere in the next few months, do I still need to apply for advance parole/I-131?

4. Similarly, I am currently on students visa, do I still apply for EAD/I-765?

Please Help!!

A1: Copy with the I-485. Carry the original to the interview.
A2: W-2 and tax returns will be needed for I-864
A3: Still apply for it since it will be free
A4: See A3

sorry to bother again:

there is a fee for I-131: application for travel document. Its 305$. We would still have for pay that?

For the I-765, there is no fee:
"Special Instructions :

If you filed a Form I-485, Application to Register Permanent Residence or Adjust Status, on July 30, 2007, or after, and you paid the I-485 application fee required, then no fee is required to file a request for employment authorization on Form I-765. " -------- uscis.gov

As far as my understanding is, I-131 is also free if part of an I-130/I-485 combo. I may be wrong. Search this sub-forum. Plenty of such cases.

Thanks .. Got it ..
this is on the USCIS website--under I-485 sp. instructions: Please note that, if you file Form I-485 to adjust your status as a permanent resident on or after July 30, 2007, no additional fee is required to also file an application for employment authorization on Form I-765 and/or advance parole on Form I-131. You may file these forms concurrently.

do I need to submit my I-20/I-20s in original? Is that risky or will they be returned?

Also,

Is affidavit of support, 864, submitted by the citizen sponsoring the spouse OR the beneficiary, i.e ME?

Thanks!

The I-864 is submitted by the citizen sponsoring you. If they don't make enough, then they have another adult that is a PR or USC co-sponsor. However, the citizen that filed the I-130 petition must submit an I-864 even if they don't make enough money.

What I did for my I-864 is I contacted the IRS and requested a tax transcript and a transcript of my 1099's and W-2's and included that. USCIS would take either a copy of the actual tax form or a transcript.

My recommendation would be to submit a copy of your I-20 since USCIS takes forever to return originals. However, you should direct this question to the DSO at your school.

And more qs.

Hi everyone,

1. does the I-94# change? whcih one do I put for my I-765?
2. for question 16, in I-765, for eligibility categories, do I pick c3b applying for OPT post completion OR for a K3, family based non immigrant spouse of US citizen??

1. does the I-94# change? which one do I put for my I-765?

According to the question on the form, if you have ever been issued an A# (alien registration number) then you put that down. If you do not have an A# then put down the number on the I-94 (the little white form that should be stapled in your passport).

2. for question 16, in I-765, for eligibility categories, do I pick c3b applying for OPT post completion OR for a K3, family based non immigrant spouse of US citizen??

Are you applying for your EAD based on your I485 application or an endorsement on your I20 from your school for off-campus employment?

Thanks for the quick reply.
I am applying for EAD thru I-485.

Also, about the I-94. I have two of them stating 2 diff. numbers.: 1, and 2, as explained:
1: frm 2001, old one that was issued when I received my I-20 (while I was in the US, my status that I came in the US was with H4-Dependent on H1, my father)
2: frm 2007, from re-entry after my visit to UK.

The code that you would use for your I765 is the one for a pending I485.

You have 2 I94s in your passport?
The older one should of been taken from you when you departed the US after that stay. My recommendation is to use the second one that you received in 2007; however, I am not a lawyer so I can't give you legal advice.
