My EB2 case is current from Feb-06 but soon I came to know that my case is stuck in name check.
Recently, myself (also little bit later, spouse) appeared for Bio CODE 1. Also we got RFE on birth certificates and we responded too(confirmed by LUD on cases which appears papers are received and processed by USCIS). my question is - DOES THIS SOUND LIKE MY NAME CHECK IS CLEARED? I am hoping the name check is cleared but the activity could be as well due to PRE-ADJUDICATION nuisance by NSC
I have not made additional enquiries about the status of name check after the initial inquiry, which is some 3 months ago!! (just lost interest )

Need some info RFE & Bio when name check pending
All,
My I-485 EB2 PD: 07/2001 case is stuck in name check, as of Feb-06. That's when I last inquired thru senator.
Couple of things happened after that:
03/20/06 - I received Code 1 bio notice and appeared for it.
The first FP was given on 12/2004 and looks like expired after 15
months. Spouse's FP also expired but did not receive Bio code 1
notice.
04/25/06 - received RFE for self&spouse on Birth Certificate
Responded and on-line case status message changed on 05/22 as
RFE response received
05/21/06 - spouse received Code 1 Bio to appear on 05/24.
(3 days in advance!!.) done.
Does this sound like myself and spouse name check is cleard and close to approval? If every thing is OK, how long will it take for approval after RFE response message change?

It does not mean much - your name check started after Oct. 2004. Before your name check is cleared, USCIS will process the case anyway.

Seems my NC is cleared
Seems my NC is cleared in Second Week of May.It was initiated in Sep'2004.When I called the VSC last week, I was told that our NC got cleared and now we are waiting for Visa Availability.There was a LUD change on 05/26.
