Stuck in Name Check??? Let's track it

FBI Name Check Clearance
The only way out of this is to get an FOIPA with "No Record" or "Hit" and then send this information to the SENATOR of your state. Now after you do this and wait for maybe a month, you then file for "Writ of Mandamus" $150 with a lawyer and take the FBI to task. I have been waiting since 05/08/2003 and am ready to file a Class Action Law Suite against them. Who all are with me ? Enough is enough they are the Servants of the US govt and we pay taxes and they cannot afford to mess with us. It is their Duty to fix this and they will fix it. You wait and see. I am taking them all the way to the Judicial Court and getting an Answer once and for all. Who all are with me I ask ?

As far as i know most people who are stucked with the name check are from arab/muslims countries or china .
And since my surname its really uncommon ( german) i was wondering if i have to consider my self to be stucked on name check since my Biometric happened 3 months ago.

Anybody can be stuck in Name check . Such are the mysterious ways of USCIS.
Though a highly (in) efficient body FBi is huge Under( worked) staffed.
So please be patient. In another 6 months it wont matter as you will get used to this waiting.

Anyway, i thought that most people who are stuck are from Middle East and some countries of Asia.
I am not Europeans as i said, but i just asumed that being from Europe, Canada, australia, NZ and have an european surname was a plus to have a faster approval.
Now i understand being from Middle East or have Arab or Islamic names it's and not better nor worse for USCIS and we all are treated equally. am i correct?

Lets cut this "class action" discussion here, unless you find 30 people who can shell out 10K each.
In class action suits are paid for by lawyers and these suits involve big companies with lot of money. If the case is won, then the lawyers get lot of cut.
In this case, you dont get any monetary benifit, so no lawyer is going to support you.
I have filed 140/485 on Dec 23rd 2004. I got 140 approved. I am also part of Retrogessed countries. I called senator offce last week to request status inquiry on FBI Name Check. I don't know whether my name is stuck or not. The lady took all my details including 485 receipt number. I clearly told i just want to know the status of Name Check. She called today saying everything is cleared and waiting for visa number. But she got this information from Vermont Center not from FBI.
Anyone has any idea whether Vermont customer service has access to Name Check status results...I read somewhere they don't know..

luck_2005, not to discourage you, but it is possible. I had senator/congressman contact USCIS since Jan 2005, they were both told my background check was complete. Until recently I was told by USCIS that FBI name check is still pending. However, the email from FBI (they stopped sending status inquiry) has been telling me my name check is pending.
Difference Between National Visa Center Name Check And Fbi Name Check
.....Since i only have few months in the USA it's still unclear why we need to do a backgroundcheck again that only causes delay in our application...
Does anyone know if our namecheck procedure ( Fingerprints/ biometrics) is different from the visa namecheck at the NVC?

a lot of people can have misleading names of who they are not. I have seen japanese with Irish name. so it doesn't matter what your names are. if there is a hit in the initial check, then your file will be sent to the "pile".
some people here are 2 to 3 year name-check-veteran. so be patient. your case will either be approved soon(hopefully that's the case for you), or, possibly, won't see the lights of day for a long time.
but relax if you have to wait, enjoy life anyway.

FBI probably has millions of people on their record with numerous criminal records from varoius race, religion, or origin of country. Just because you have european surname should you be treated differently.

HI TO ALL I have reading threads since six month now first time i am writing my story i file my labor in jan 2000 then i file I-140 feb 2001 and I-485 may 2002 i got my AOS interviw aug 2004 immigration officer told every things ok but your name check not compleat yet so i can`t approve your case he told me you will get between one week and three month . since that day i am waiting i visit every other month local office (Newark,NJ)every time they told me same one anssar your case pending in name check . god knows when i am gona get my name check complet.

I filed my complaint late October after waiting for too long on my namecheck with I485 RD March 2003. Now VSC has 60 days to reply to court.
