Still on H1B but married to a USC

I am in H1B since oct 2008.My employer refuses to pay as i was not in any project.I was married to a USC a month before,now am thinking i should sue them or contact DOL to get the money.

But if i do,will it affect my future GC processing through my USC wife....?
I kind of need that money to apply for my GC.

any suggestions.....

I'd suggest you get the process started first. Even if you take the DOL route, it's unlikely you will get the money any time soon, and you should get into legal status ASAP. You are out of status right now.

It's $1000 - surely you can put that on a credit card and pay it out of your wages at your next job.

Will this affect my GC process through my wife....if i sue or contact DOL....
 
My company is in virginia and i live in kansas...in which state i need to file compliant to DOL....?
