Still have questions: Traffic, mailing

I searched and read the threads - need some help please.

1) Traffic citations: I am listing all 4 of them in the last 5 yrs. Should I write that all my violations incurred have a fine of less than $500

2) Can I mail mine & my spouse's together to San jose, CA - can application fee be in one check too?

3) Is there things I should watch out or avoid - say common mistakes people make?
 
1. No, it's clearly written in the guide book not to include those citations.
2. You don't mail it to San Jose office. You mail it to the office in Phoenix, AZ. San Jose branch is just an office for USCIS. The main headquarters for San Jose or shall I say CA are in AZ. Look at the guide book you will find their address. Or you can dig through the old forums to look for it. One check for 2 people is okay.
3. Don't lie. Read the guide book before you send the application.
 
The exact phrase from the guide:
Even if you have committed a minor crime, USCIS may deny your application if you
do not tell the USCIS officer about the incident. Note that unless a traffic incident was
alcohol or drug related, you do not need to submit documentation for traffic fines and
incidents that did not involve an actual arrest if the only penalty was a fine less than
$500 and/or points on your driver’s license.


It does not say anywhere that you need not disclose traffic fines, only states that documentation is not required to be submitted if fines are under $500.
 
I chose the "will not disclose traffic tickets" pill..... choose your pill wisely, some on this forum will tell you nay some will tell you yay...you just have to make your own decision and live with it
 
The guide and instructions state not to include documentation for traffic violations under $500. It doesn't say not to disclose them altogether.

Note that unless a traffic incident was

USCIS should revisit this question to avoid the confusion.

I have a ticket, a red light violation, paid $300. I don't have any documentation. I went to court to get the details and they don't have the records as this ticket is >12 years old. DMV doesn't have any records too. I called 2 immigration lawyers and both of them told me to answer no to the Q 16 as I don't need to mention this on my application.

I do agree with others that you need to check if you have tickets and you don't need to show/send documents. I always wonder what should we do during the interview if the officer asks for documentation?

Should we say I didn't carry any details with me (according to USCIS instructions) as the fines were <500 and there is no arrest? (How does the officer believes you..do they have any online system to check to make sure that ticket is under <500 and no arrest? If not, will he do a face reading or judge your confidence level and decide to approve the case or ask for more information by rescheduling the interview? :) )

To avoid the confusion I decided not to show that in my application. If officer asks me, then I will tell him about my traffic ticket and reason for not having any documentation.

Any IO with common sense will believe that. They don't give you a hard time over a ticket of fine less than 500 and/or points on the record. Most likely the officer won't ask you about the ticket that you're mentioning if the fine was less than $500.00 and if he asks for documentation which is HIGHLY UNLIKELY then you tell him that it's 12 years old and there's no documentation. Don't stress over irrelevant things..
