Status of my wife ?

Hi,

My wife was on H1B and was working for employer A for few months. Later no project for 2 months. Meanwhile (during the 2 months) she got EAD because of my I485. I have applied I485 for her also. Then employer terminated her H1B (i.e informed USCIS) as she got EAD/AP already. She didn't use her EAD for any purpose for few months i.e from the date of termination of H1B. Afterwards she has used EAD.


My question is what was her status from the date her H1B terminated and the date she has used EAD (about 1 or 2 months) .

If you filed I-485 for her before her employer stopped paying her she is fine. Otherwise she was out of status and her I-485 might get denied, unfortunately. Talk to a lawyer.

If H1B is terminated after applying the I-485 no problem. Important date date I485 receipt date not when the EAD was used.
