Started a company on GC and want to process New H1's from India

Hi,

I have started a company as s-corp last month. There are no employees. I work for my original employer. So no income for company yet. I would like to process h1's for some people in India. My questions are:

1) Is it a good idea to process h1 with out any income and not running payroll?
2) are there any chances of rejection? If rejected once, is it a black mark for the company?
3) Do I need to show the job for the h1 to be issued
4) Should i open a buisiness account? What kind of amount should I have in the account
5) H1 quota still available for this year? Where can i get the latest update on the no of visas applied/available?

I really appreciate if some experianced person replies to these questions asap.

First you have to prove that you have confirmed project for your employees those who are coming through H1.

Your paid up capital, and bank statement.

Your office lease agreement. And business plan.

Previously it was possible nowadays, even if you manage to get h1 approvals, getting visa stamp out side US especially India for a new company is out of question.

Thanks guys for the info.

Joe i am not going to abuse the H1 program. One of my friend is working as SE in india and he want to come here on H1 and look for a job. I think most of the H1 are applied this way. I don't know if you call this abuse. This is more like chicken and egg issue. Unless you have H1, you don't get a job, unless you show a job they don't issue H1.

My suggestion would be to first start working for your company. Once you do that you would have some revenue generated and you would be able to show the ability to pay. Also you can then start actively marketing your friend too. If you sell your consulting services via big temp staffing companies and they like what you do, they would help your friend find a contract too (via your company, of course). And since they have good feel of the market, they would be able to give you some sort of intent letter, if you have proven your worth and are sure that your friend has sellable skills.

Now on the other end, provide full service to your friend and make money out of the whole equation. Do not assume that he would come and find the job himself. If he is on your H1, he is your responsibility. Do not do anything that is unlawful like benching. Make it clear to him that there is procedure that needs to be followed. While you would assist him find a contract and would be his employer on record, you would take your fee (or cut) for what you are would be doing. Also convey him the risks involved, if a contract could not be found (you would have to let him go with one way ticket to India). Hope that helps.
