Hi,

My wife is currently on H4 and does not have an SSN number. We expect to get our EAD approval soon. Once she gets the approval before working does she need to get an SSN number? If yes, then how can she get an SSN number.

Any suggestions would be greatly appreciated.

Thank you.

Good luck to All !!!

------ once she recieves her EAD card, she should go to nearest SSA office fill up the form for SSN and should show EAD and passport, SSN will be sent by mail

Is it a pre requisite to work?

Ginnu, thank you for the reply.

Can she start working while she gets the SSN number or does she have to wait for the SSN number before she can start working?

How many days does she have to wait for the SSN number after applying? ANy experiences there?

Can she be on payrole with out SSN#?

Hi,

my wife is in the same situation. Can she start using EAD without SSN#
and be on payrole? Or does she go on payrole only after SSN?

In general, if one is on payroll, employer has to deduct some amount
towards Social security then is that legal to go on payroll without SSN?

Thank you in advance for your answers.

While it is legal to be working after receiving the EAD but still awaiting an SSN (you are allowed to claim that you're waiting for your TIN/SSN on the W9), reality is another matter . Unless your employer is using a homegrown system to process their payroll, most big HR systems are not even going to allow you to be set up as an employee unless you're able to provide an SSN.

Then there is an entirely separate issue concerning remittances which impacts large employers thus making it unattractive for them to pay anyone without taking the appropriate tax deductions.

Thus, I wouldn't be surprised if anyone is not hired before the SSN/TIN is received.
