SSN denied to an Asylee?

Hi everyone,
Based on the previous thread i thought that now asylee don't need and EAD. So, I went to our local SS office in Milwaukee, WI to appy for an unrestricted SS card. She took my application and told me that it will take 4 to 6 weeks. Last Friday I called and left a message. Today there was a message on my phone saying that INS would not give me an unrestricted SS# until I become an LPR. Why SSA is asking INS to issue me a SS card. I thought they would verify my status with USCIS and give me a new unrestricted card. My EAD will expire in early December. She even took my old one. What Should I do?

First, you don't need an EAD to work. Just show your I-94 to your employer.

The second, go to SSA to find the exact reason. Sometimes, they make mistakes. I went SSA four times and INS two times just for one SSC.

About two weeks ago I went to my local SS office. Showed them my old SS (with INS restriction) and said I want to replace it with a new unrestricted one.
I even tried to show then a memo about ssylees eligibility, but the woman wasn’t interested. She took my application, my old SS card, took copies of my RTD, my I-94 and my DL. She said they have to verify with INS first and if INS approves, I’ll get my new card mailed to me. So far I’m still waiting…

Asluser! sometimes a person, who already has a work and doesn’t even need to show his/her SS cart to anybody, still wants to get a new, unrestricted SS card, just to feel like a “normal” person. And - because we are eligible for such unrestricted card.

Punjabi! You have to call them again, or better – go back to your local SS office and complain.
There is no reason why you shouldn’t get your unrestricted SS card.

SSA idiots

I called local SSA office back and the lady I talked to had kind of salty attitude. Obviously she didn't know diddly about immigration rule but she was stubborn as hell. :rolleyes: She told me that INS has told them that I came here as asylee which is not true I got asylum after I came here. Also that my status is not asylee anymore it has changed to temporarily allowed to work once they INS issued me an EAD. I'll still get a restricted card and I'll have to keep on renewing my EAD. How stupid is that? :eek: I called this number 410-965-2737 and told them about this. They took my full name and phone number and told me that a specialist will be calling me back. What a bunch of crock :mad:
 
Hmmmm… you know, I got my SS back in 1999 and now trying to change it to unrestricted one. But my son, who is derivative, came here after approved I-730.
He came here as an asylee and I applied for his SS in 2002. He got unrestricted one!
First I thought it was because he is a child and cannot work anyway, but then I learned we all eligible for such card. So whatever they told you on a phone is a bunch of ****
Keep your spirit up, you should get a card.
 
i guess, i was lucky with my SSA lady.

I went there, gave her my old SS (restricted) and just showed my I-94. She said: " oh, ok, asylee? no problem."

She even did not take a copy of it.

i was told i would get within two weeks. I got it after 4 days (!).

i guess it all depends on a person in SSA, how professional he/she is and knows the simple rule that asylees ARE eligible for unrestricted card. :(

Be relax. It is not you alone. The problem is from INS. The computer systems between CCA and INS don't directly linked for asylume part. So the normal process is no working for asylees. SSA always find the your former status before asylee.

Going to SSA and request them to get secondary reference from INS. That takes 2-3 months.

I also had a lot of problems getting my SS as an asylee. Worse, I never had a restricted one...I didn't have one at all.
They kept telling me I could only get one with EAD, which wasn't approved yet, but like PEACH said I wanted to feel like a real person and wanted to get mine,besides I wanted to work.
After more than 4 attempts, a lady at an office where I had tried twice before took my application. One detail: I didn't even have a I-94, but an approval leter from the judge, so they really didn't want to take a piece of paper in the begginning.

Thaat lady who accepted my application said the people who turned me down
didn't know what they were talking about, that ANY DOCUMENT stating your asylee status is valid for the application. Of course she verified with the INS right there. YES, I waited and she came back with a paper like a fax Ok'ing me.
A week later a got my SS card. After 5 attempts.
Those people don't know sh... about immigration. You have to kind of tell them what to do. We learn the hard way, and they were born with their green cards.
Another thing Punjabi_Munda: Like they say in this Forum: these are NOT official advices, even an attorney can't give you 100% guaranteed advices.
One thing I know is that asylees DO need an EAD. You just don't need one right after you are granted asylum, because of course it takes a while to approve.

I've just recieved my ss card.When I stopped by social security office to apply for it, the officer said I would get my card with restriction sign (the same one that I already had).I said I am eligible for the one without.We started to argue.Eventually she looked through her instructions and found that asylees were not permanent residents.I said that her instructions were too old to be true.Luckely her assistant came in and said that they had some other, I presume new instructions. And in 5 minutes I had my receipt.The problem is that guys in ss offices are not familiar with new regulations.My suggestion - ask them to look through their new instructions if it doesn't work call to ss free 1800 number.They should give it to u.

Thanks guys for your replies. I did take printout from USCIS website and SSA web-site that tell SSA people to issue an unrestricted card to an asylee. But I guess like you said, it really depend on your luck and the person you run into at SS office. If that person doesn't know or doesn't want to know, you are screwd. I'll wait to see what my complaint with SSA brings out, otherwise I'm just going to go to a different office.

I applied for unrestricted SSN last year, and they sent me one with restriction. So I went again and applied again and finaly I got the one without restriction. Both times SSN people were nice to me and both times I had all the documentation I needed. My advice, try again and go to different office and bring all the documentation you can find.

Last time, i also had hard time in getting a ssn , but i called the number and they send me to a local refugee resettlement office and one officer helped me out by giving me a letter. As the result, i only need this letter plus my I-94 to get a ssn. they will have all your identity information on this letter, so no EAD ,no ID, and nothing else required.

I went SS office, she tried to call a # to check me in the system, but I was granted in 1998, so she made me fill some forms and made a copy of my granted letter and told me that they will check with INS, and if everything is ok, they will send me a letter and issue a new card, I received a letter after few weeks, that I will be getting my new card, and within a week new card was mailed to me with no old BS.

When you have problems with a window clerk, ask to speak to the manager and if needed, then go up the chain of command.

Actually asylees DO NOT need EADs to work. They DID in the past but the rules have changed.

Punjabi_Munda you might send e-mail to the SSN Commissioner in Baltimore, MD and explain what really to the local SS office that what I did when I was MD 3 years ago and mine was resolve.
