While I am waiting for my citizenship to be done, can I sponsor my wife for tourist visa? Do you think they will allow my wife to come to USA on tourist visa to meet me?

Should I get her sponsored for tourist visa from someone else?

Or Should I wait for my citizenship to be done and then file her GC?

What might be the best option? Any suggestion is appreciated... Didn't want to surprise her with 0% hair after some years...

If the consulate where she applies finds out that her husband holds a GC and is a perm resident here in US, they will refuse her tiurist (non-immigrant visa) in a heart beat. Since you are holding a GC and maintains a perm residency here in US, she will be asked to apply for an immigrant visa. Your best bet here would be to wait till you become USC and then apply her I-130 for her thru NVC process.

Another idea would be for you to meet her in another country (ex: Canada) and spend a vacation with her there.

Thanks Atlanta Brother... knew that but was just curious. It is so weird, they don't give toursist visa to someone who will be permanent resident down the road... well it is also weird that they give dependent visa for spouses of poeple holdng H1 or even F1 visa.

options

Hi GB,

1. You can try for tourist visa. (There is a possibility that it will be denied because they will think her intent is immigrant although she applied for a non immigrant visa). This is actually stupid because everyone knows spouse will come here on non immigrant and eventually apply for immigrant visa anyways).

2. If she has any relative uncle, aunty, cousin have them try for tourist visa.(although immigration will ask about you anyways). If she is lucky she will get visa.

3. waiting for you to get citizenship and then try for her gc will take at least 6 to 9 months min.(This depends on whether USCIS will keep their word of clearing namecheck).

4. If she can come and stay in canada and if you can visit over weekends that is one option.(e.g toronto and you can commute over weekends from NY)

5. Get yourself busy with some course/certification so your waiting will be somewhat bearable:)

I know..not a lot of options but hang in there I believe you may hear good news by July if not earlier.

Regards

Thanks waiting for great advice and inputs... the part keep yourself busy with some course or certification was something I never thought about... thanks!

In your situation, I would have married her and waited for my N400 to be done and then apply for her GC... people do that all the time. I would have dont that too, but they might deny her tourist visa. Once you apply for GC, I don't think they will allow her to come on tourist visa.

Once you apply her for GC or once she overstays she can of course go back, but cannot comeback until her GC is done... I don't think they deny GC for a spouse of a citizen if she/he are not in trouble with law... I have seen many cases like that unless they have changed the law now.

What if you let her go once and then she comes back in tourist visa when you get your IL (since they are talking about fixing the name check backlogs) and then you apply for her GC while she is in legal status?

If i were you, i will give it a shot you have nothing to loose except the fees. NIV sometimes depends on the luck. From 2002 to 2006 my family members was able to get 7 visas "B1/B2"

Goodluck!

I know many who take them here on a Fiance' Visa, marry them here and then apply for the GC from here.
In your case I don't know. You can try bringing her here on a Tourist Visa and then apply for the CG but not sure how that works out for you guys because I never experienced something like it of know someone who does.
