No. People in the immediate relative category cannot have derivative beneficiaries. The petitioner should petition the other parent directly if the parents were married before the petitioner was 18.An american citizen who sponsor his father (or mother) once the petition approved, can one parent also bring their spouse?
Filing I-131 for what? Advance parole? Advance parole is only for Adjustment of Status applicants (people applying for green card in the U.S.). Are they doing Adjustment of Status? An American citizen only file 1 I-131 for both parents? or 2 separate I-131 needs to be filed?
Yes.I mistakenly wrote 131, I meant 130.
So in this case, they were married before petitioner was 18.
What I understand Petitioner should file 2 petitions. separate for mother and father.
My aunt wants to bring my grandmom (her mother) to the states via immigration, so that my grandmom can apply for my father and then my father can apply for us. Will this process work. If so, how long on a average could it take?
Wow, that's a long time. Its just that my aunt did apply for my father back in 2006 at the Calafornia State Center. The people there lost our application and we only found out about it in 2010. Then, we reapplied in 2010 (although they admitted that the application was lost because of an error on their part) and now i find that it will take us till 2022 to get immigrated. Is their anyway to expedite the process so that we are counted as a 2006 applicant. I mean its really not fair and we were really hoping that we could come there by 2018.Is your aunt a US citizen? Assuming she is, your grandmother should be able to get her GC in about a year. I am assuming your father is married, so your grandmother needs to become a citizen first and then sponsor him. 6 years for her to become a citizen and then around 11 years for your father to get his GC.
Your aunt can actually sponsor your father. That should take 12-15 years.
