I want to Sponsor GC for my Parents. They are in India

1) How long does Consular Processing Take?
2) How long does AOS Take if they come here on a Visitor Visa and then we file. They have a valid Visitor Visa

Which route do you folks recommend more?
Please share your experiences so i can make a decision which route to take

Thanks

Go via the consular processing route.

Triple Citizen,

Do you recommend the consular processing route for all parent cases where the parents currently don't have entrance visas to the US? I ask because my wife (who should be a citizen early next year) wants to bring her parents over. Her parents currently don't have even visitor visas to the US and my wife and I can't see eye to eye on this matter. She thinks visitor visa with AOS, but I feel consular processing is not only more ethical but cheaper.

CP is the ideal way to have GC for parents. You can do AOS once they are in USA, and they deside not to go back home.

Assuming they make it in, and don't get sent away at the border. It also assumes they get the visa in the first place. Don't think that DOS isn't aware of the large number of parents who attempt to use the B as a "pre-immigrant" visa.

Yes I do recommend CP route for all such cases. If I had it my way, I would make B-2 status holders ineligible to apply for AOS :)

I agree with your statement. I explained to my wife even if they are issued a B-2 visa at the embassy there is still no guarantee they will be allowed into the US, or even if they are allowed in an CBP officer might write NO AOS on their I-94.

What I also explained to my wife the difference of AOS and CP is the price. AOS cost $1490 per person in government fees plus at least 3 months of not being able to bring money in. CP cost $738 per person in government fees plus the ability to work and tie up loose ends in their home country while the application is pending.

Let your wife win this argument, dude. Have them go ahead with the B2 visa attempt. It's a 90% chance their B2 visas will be denied given that they have to mention having a USC daughter living in the US, so the situation will take care of itself and they'll have to pursue CP anyway.

Most of the other people whose parents entered with a B2 already had the visa before their US-based child(ren) naturalized. Your wife's parents don't have that advantage.

Thanks for the reply.

So, how long would the CP process take for a USC sponsoring parents, I already know the USCIS I-130 approval takes up to 5 months? Could someone also please provide me the process for going the CP way once the I-130 has been approved by USCIS and the file is transferred to NVC?

In regards to the I-130, I know we would mail it to a USCIS lockbox, but what service center would process it for a I-130 filed with a Maryland mailing address? I hope if it is Vermont, it is not the same team that processes the I-751 papers.
