Hello,

I have a brother, to whom i will be sponsoring. I will fill 1-130. mY BROTHER is married and has children.

Do i have to fill application for each of them and the fee will be $420 for each.

Or it will be just one application with names of my brother and his family and only $420 fee for filling?

Please let me know.

AS a USC, you file only one petition for your brother as the principal beneficiary. When his priority date becomes current, his spouse and unmarried children under 21 (with certain exceptions covered by CSPA) will be his derivative beneficiaries and the all file Immigrant Visa Application atr bthat point in the future. He should provide all the evidence up front now for you to include (marriage cert, kids' birth certs.) and any new kids can be added later and IF he changes wives (widows and re-marries or divorces and re-marries) he can sort out the paperwork later when they files for the Immigrant Visas.

YOU, as the I-130 petitioner, will have to file I-864's for all of them in the future when they get ready to immigrate. You will file one original with fee and just copies for the derivatives.

---------------you have to file only one 1-130 for your brother but on I-130 you need to write his wife name, children names. you should get Birth certificate of your Brother that has name of your Father or Mother. you will also need the copy of brother marriage certificate, copy his wife birth certificate, children birth certificates so that you fill the correct names and correct Date of birth for all. if all have passports then get the copy of passports so that you can check if DOB of all match with birth certificates.

if Brother born in India then wait at this time is 10-12 years. many from India don't immigrate at this time as they know the condition of US. Most of Indians from Gujarat state still immigrate as they have many relatives in US and may get job in motels or stores.
