sounds like a big tax problem

Hi everybody,

We got married in July outside the US. My wife (USC) is back in the US now. She is preparing to file for I-130 but in the meantime, she is going back to school and filing for fafsa. Yesterday, she found out that she needs her husband's tax return paper of 2006 to be able to apply for fafsa. Now, I was not in the US from april 2006 onwards and thus i could not file. My wife says she might not be able to get financial aid if she does not have a copy of my 2006 tax return. And she also said that it could be charged against me as a federal offense. First, our I-130 might not get approved because of that and second i might not get an immigrant visa even if my I-130 gets approved. What are her options guys, can she go alone and file back file my taxes for me?

Please help guys.
 
Did you work from Jan to APril of 2006 in the US? if not, you were not required to file a tax return. Even if you worked, but earned less than a specific amount - you didn't have to file anyway. Your wife could probably mark somewhere that her hubby is a foreigner and doesn't work or reside in the US.

Depending on the answer to LucyMo's post, you can try calling the IRS. Sometimes you get someone helpful other times not. It actually might be better to call the closest H&R block.

was on F1 visa

I was in the US on a student visa from Aug. 2001 to April 2006. I had taken spring 2006 off to come to my home. But I did not come back right away. I stayed for 81 days before coming back to my country and left US only on Aprill 11 of 2006. I worked for 10 weeks from Feb to April of 2006 and I used my own SSN number to do that. I have worked without proper authorization for four years in the US using my own SSN. and I have filed taxes for all years except 2001 (I did not work in 2001) and 2006 (I was not in the United STates). I made little over $10,000 from Jan. to April 2006 (I exempted the taxes at that time coz I needed the money)... Now my question is ...can I and my wife claim that since i was not in the US, I could not file my taxes ? Can she back file my taxes for me ?

Pleeease help show me a way guys.

You don't have to be physically present in the US in order to file your taxes. Once you have your w2/1099 from your former job you are good to go ( if not, call them and request a copy) check out the irs website to get the forms and where to mail them.

I think you can also file it online at http://turbotax.intuit.com/
Not a 100% sure what that website offers, but take a look or you can pay someone to do the work for you.
