Solve my dilemma

Hi guys,

I am in kind of dilemma and need your valuable advice. Here is the scenario.
I am an asylee . My I-485 is in process(RD sep 2001). I got a full time job in a software company based on my expertise in my field. My status in HR is an Asylee. Now our company has planned to hire some outsource resources(from my country:-)), for the project and made me incharge of interview and training them. Now my immediate boss(also from my country) is on H1B(work visa) & does't know my staus. He likes me and therefore offered me to go to my home country and train these people on company expenses and have a vacation too.
Now what should i do. If i tell him that i can't go to my home country bcoz i am an asylee, am sure his attitude towards me would change to a hostile. But , if i go, then INS would raise their eyebrows. Tell me what to do???

I am sure you won't like that but do not go home before you at least get your green card. Many individuals who went abroad and came back were asked if they visited their home countries. They were asked this question to see if they committed fraud. Even if you get your green card, they may still take away your green card if you go back home. Miami 2001 talked extensively about this issue in previous posts so search for his posts. Remember, you are allowed to stay in America because you proved your fear for your life and going back to your country may discredit you and may cost you your green card. Your boss does not have the right to discriminate against you based on this information, but he may report you to your government, which may then retribute against your family. If I were you, I would just tell the man that I do not like to go home for family reasons (i.e you can not leave your wife, you have to care for your children, etc. ) Just DO NOT GO. Good luck
 
Well i am sorry you are in this situation. If you can..try not to reveal your situation. Just let him know that you can't go back because maybe you have things in u.s that you can't be away that much time...! If you aren't married..make an excuse of getting married or if ur married..say you are expecting a child..! Just try not to reveal much but make it something personal...

I hope you solve your problem.
 
don't lie, you will get yourself in more problems. Be open with him and see where it goes. He is from your country, he will understand. Maybe you can try WEBEX (web conferencing). hope this helps.
 
I am sure he will never understand that. How would you feel if you a more qualified and in a high position but still don't have green card and person who came 4 years after you, can work where ever he likes?
 
this one is not even an issue to discuss. you have political asylum in this country. therefore this one is "protecting" you from your native country because you have or had a "well-founded fear of persecution" there! of course you can't go back!

what would be a purpose of political asylum then?

as far as what you should or shouldn't say to that guy ("boss") or what he may or may not think, has nothing to do with political asylum in this country.

Even for people with asyum-based green cards whether you can travel back home is very much open to debate. For people who are still waiting for a green card like you are, it is very clear. You would be out of your mind to go.

Sure, one should not lie but what if lying will protect your family? I assume that this boss belongs to the majority that oppressed you and caused you to leave your country. You do not want trouble for your parents/brothers/sisters. I had a friend whose parents were tortured by the fascist authorities in his country after his picture was shown in a web site that helpes refugees and asyless from the Middle East. Being careful necessitates lying sometimes.

Forgetting the INS for a moment, do you have any concerns about your home government and/or your persecutors?

agree .. I even know some cases where USCIS let war criminals (from my country) to come as a refugee and SAME war criminals are now living close to the members of family they killed. They even threaten them that they will do it again if they have chance. They have citizenship, and some of us don’t even have a green card. Where is justice there. Maybe in 50-60 years USCIS will discover this and deport them (like they doing to nazi Germans). Again, the police here don’t care at all, because they are now law abiding citizens. Don’t you hate these kinds of stupidity from USCIS?
Considering this, I would understand your point shamshon.

Considering this, I would understand your point shamshon.

The US govt can not tolerate past war criminals.I suggest you and other asylees who have knowlegde of those war criminals,file a complaint to the justice department.

I doesn`t matter whether those war criminals have become US citizens they can be ripped off their US citizenship and be deported.

I can`t tolerate such criminals due to my personal experience and can`t spend a night sleeping without doing anything about it, now that they`re threatening witnesses here in the US.

I strongly suggest gather your friends and contact the justice dept they have a dept which deals with specifically international war criminals and they have helped a bunch of people.It`s even much easier since those thugs are here.

About you going home just forget it unless you know that you are not coming back in the US.

that is what we were thinking to help this family, but these guys are not
"official" war criminals. They are executors and their names were not recorded anywhere. There are only few witnesses that survived massacre. Only one family is here to witness (actually mother and her kid, father was killed by these guys). They have very high paid lawyers (paying with the money they took there) and good luck trying to prove this case in the US court. Their lawyers would eat us alive. Very sad ... but the justice will be served one day, I'm sure of that. Just patience ...

This just proves how they check refugees and what we have to go through to stay here. Very very sad ... shame on you USCIS.

War criminals don`t necessarily have to be officially listed.It takes people like you and your friends to initiate by giving their names to the appropriate dept.
 
You should call and let INS know, you don't have to live your name,INS will be trilled to deport thos ,individuals.It hapepen with cillers from my olld country they will be striped from US citisenship in one day ,and Deporten in few month.
You should play it safe remember when you was there ,think about it .
Play it Safe man.Just say no .You cant live USA it took you long time to come to this point.
 
Here is some practical advice from the "corporate" point of view.

Dear Asylee13,

You are in a strange little situation that could cause you problems down the road. People can get very political (I mean career-wise) and you need to be careful. You should immediately talk to the HR Manager of your company and explain everything to her/him. They should be able to take appropriate action without you having to communicate to your boss. All you need to tell your boss is that for personal reasons you would prefer not to go to your home country. Further inquiries are not necessary.

I know exactly how you feel. I don't hang out with my fellow-countrypeople much, but when I meet a new person from my country it becomes very tricky to answer some questions.

So I have learned to just say: "I don't want to go there for personal reasons". End of story. Further questions are inappropriate in the US, and your boss will have to learn that. For practical purposes, you can also just say: "I'd rather not discuss it"

But DO MAKE SURE what is happening is documented. You don't want it to look down the road like you refused to help the company. Good luck.
 
Thanks folks for very very helpful suggestions. No doubt this forum is a platform for every asylee to talk about any issue and get best feedbacks.
Let me summarize what most of you have suggested.
1) Don't even think of going back
2) Do not tell boss about my stauts. Instead make some good excuse for not going.
But Expresguy, let me tell you ,any boss can go and lookup your immigration status in HR , if they want to. In my case may be he thinks i am just a GC holder( that's what i told him) so he never got suspecious. May be one day he would. I'll face it when it happens.

You forgot one other thing have that thug the war ciminal taken care of.
