Sister is disabled and her husband is indocumented

Hi,

My sister just became disabled. Her heart is not pumping properly and she can't work. Is there anything she can do to legalize her husband's immigration status without having her husband going out of the country for that 10yr bond? Thanks.

If she is so disabled that she must rely on her husband for day-to-day care, he might be able to qualify for a hardship waiver.
 
Your sister should be able to qualify for a hardship waiver on the basis of her disability. If her husband were to be deported, she will suffer under hardship as she won't have a spouse to look after, forcing her to have to try to hire a full-time nursing staff. If she gets help from a lawyer for pro bono, which will save her some money, who clearly is familiar with such waivers, it will be helpful to her.
 
If she had been working, she will likely qualify for SSDI and short and perhaps long term disability from her employer (assuming she was properly reporting and paying taxes on her income). She should contact her states department for disabled residents rehabilitation services. There are many jobs that she might be able to be trained for under the rehabilitation programs. If her assets meet the requirements, she can file for SSI.

Even if her spouse meets the requirements for the waiver, it will not be fast and will require that he leave the country. Check out the immigrate2us.net group which has many people who are or have been the same position.
 
Has he been placed in Removal Proceedings or ever been picked up by INS or ICE currently or in the past?
