Hi Guys,

I have i-140 approved I485 pending for more than 180 days.

I am currently working on H1-B and have cleared EAD Card in hand.

Now I wanna apply ac-21 and move to another company.

Current employer says he will inform INS(doesnt say anything abt revoking 140).Is there anyway he will inform INS that i have moved with ac-21 and not revoke 140?

scenario 1:

I-140 not revoked, but employer informed INS that I have moved to another company with AC-21 .

If I transfer my H1-B and continue to work on H1B with new company ,Should i file LC and I-140 again with new company ?

If I want to work with EAD with the new company, should i file LC and 140 with new company?

Scenario 2:


If 140 revoked

If I transfer my H1-B and continue to work on H1B with new company ,Should i file LC and I-140 again with new company ?

If I want to work with EAD with the new company, should i file LC and 140 with new company?

I don't know. Even if he revokes 140, you are covered by AC21. You may get a NOID. In that case you should send in the AC-21 paperwork. Read the stick threads in this forum for more detail.
