Should I travel or cancel my plan

Hi Guys and Gals,
I am been confused with my travel plan. I have already got advance parole, transitvisa, and tickets. My wife is 6 month pragenant. I haven't visit my home since 3 and half years. My parents try to get visa, but they got refused five times. I am desperate to meet them. and I don't know how much longer TSC is going to hold. Even if TSC approve my case after this month I won't be able travel with my wife due to her pragenancy. So I may have to wait another 1 and half year. I am been fade up with this whole system. Please advice should I travel or do you see any problem in immigration if I am traving with pragent wife? My case detail is below

baring medical reason!
i don't see any reason immigration wise.
even if they approve your case in ur abscence you can reenter with AP.
confirm this by taking infopass appointment.

Hi Gurus,

Even I'm in similar situation. I have planned my vacation and purchased tickets. I'm supposed to travel this comming sunday (05/28/2006). Know my company is advising me not to travel since my dates are current and they might adjudicate my case any time. If they approve my case while I'm out of Ameriaca, per them I'll not in Advance Parole status and I might have problem while enetreing back. Today I called TSC ans spoken to one of the officer, per her there should be any problem.
Please advise me what should I do in this situation. My case details are in my signature.

Hi

My advise is to stay and wait for the GC becuase Air lines will not allow your wife to be on board after she become 7 months pregrent.
Or you could visit for couple of weeks.
 
nothing will happen.

Life is not just this GC man. Visit your parents, enjoy this trip and be happy. You have advance parole and nothing will happen.

i want to know if i can travel india and come back
i am on h1b I recieved my I140 my pd is 2003
if i got to india to travel will they will me to come back to usa.
Please help me thank you
 
I am also in similar situation with PD April 2001 EB2 India. 485 RD June/2005.

Going to India next week for 40 days. I spoke with my company immigration specialist. She mentioned its not an issue.

If by chance ur GC got approved when u are away. Then at the time of port of entry they will do the neccessary step and treat u as immigrant.

As skp19722003 mentioned life is not only GC. If it is Gods will you will get GC no matter what situation u are in. Trust and put faith in God the almighty.

I Came to US 2 weeks back on Advance parole with out any problem

Hello friends,

2 weeks i came back to US using advance parole travel doc. I landed detroit after 30 days of vacation. The Immigration officer just asked two questions...how long u went for? i said for 30 days.. n he asked whether i'm working for same employer.. i said yes.. that's all...he stamped my I-94 explained me that i can even go to canada or mexico for 30 days.. i dont think their any problem using advance parole to come back to US. One more thing even if your GC is approved when u r outside US. No problem whiling coming back to US. it happened to my closed friend's wife.. she was outside US for 4 months n her GC was approved after 30 days of vacation... then she completed 4 months vacation n back on Advance parole.. after one week she went for GC stamping... NO problem at all... just don't wait for GC... contiune with the normal life.. go on vacation... n enjoy.. as long as u have ur EAD,AD... ur in status..

its like taking risk i don't care if my pd is way back
i just want to travel india one time and come back
what one have to do before going india on this status which i have
i am on EB3 MY PD IS 2003
if i got to travel india will immigration or people in inda allow me to come back to usa.
with status of h1b.

I don't think it can create any problem. As long as your H1B employer and I-485 employer are same you can enter on your H1B.

If you changed you employer after filling your I-485 then it could be different story. For that you may want to check with your lawyer.

There is no issue. You can come back on AP or H1 which ever you want to. However, I advise you to use H1 to re-enter rather then AP. For more detail explanation search cronin memo on www.google.com you will get all your answeres. For your satisfaction, keep a copy of it in case if someone stop you to enter US.
 
i don't not want to take changes
+ i got H1 status after coming to us not from my home country.
my passport doesn't have h1 status.

immigration people in INDIA know very well what AP is about and they will allow u in! also here its quite normal.......i guess there are many people who do the travel on AP in ur condition..............
 
Denied Entry With Valid H$ Want To Retry

Hello my family was denied entry although they have valid H4 visa, the only verbal reason provided that I was not accompanying them and waiting in Canada for my visa stamping.
IS it ok to retry again as they have confirmed tickets from US to overseas on a week time?

have you applied for I_485 & have AP???
Did your already H1B expired?

Same here.. But I am travelling to India at the end of June.
I am making sure that I have all the documents related to my employment

Rest is upon my destiny...

you guys have applied for I-485
But do you guys have AP?

if no you can get VISA stamped right! and comeback

if yes, you can safely show AP and approved VISA papers and come right.

iguess people usually do that right!

hey while we are in this subject need opinion!

I have applied for I-140 / I485
I have approved I-140
me and my wife's I-485 is pending
She was on F1 VISA while applying
now she is visiting INDIA for month
she plans to use AP to reenter.
will that be any problem?

well i am not travelling I am very much here with approved H1B VISA papers!
 
I just confirmed with my lawyer that if I travel abroad and my GC got approved I can still come and need to do formality. About the praganancy of my wife, it shouldn't matter with immigration officer. Only Airline will not let my wife get in after 28th week. Since she is on her 21st week and I am visiting for 2 weeks, it should be fine. I will let you guys know how it went through.'
