Should i take 9 month salary or 12 month salary option?

I got a job as a faculty member at a university, they have asked me to choose if i want to be paid fully in 9 months or broken to 12 months? (Since thier fiscal year is only for 9 months).

Are there any legal issues if i choose the 9 months period? Because then it will look like i am out of status for the other 3 months? Please advice!

Yes there might be a legal issue.

Whoever is offering to do your H1 should know the implications. Maybe they have an exemption from INS. But for all general purpose and intent you need to be paid every month. So are they going to pay you for 9 months work even if you worked for 12 months? Does not seem to be right. If you won\'t be working those 3 months what are you going to do? How long wll be the visa valid? 9 mos, 12 mos, or more than a year? What is the contract period?
All these factors go into making a decision. Sorry the info you supplied is insufficient...
