Shall i go to interview or give up... please advice me

Hi .. winners

My problem is , i played Dv2011 as divorced but i did not remmber also i have add in filed of number of childern. i send my DS-230 forms as married and i included my child info and spouse too.. shall i ask KCC to delete all store Ds-230 form and resend them new form with my marital status as divorce?

Hi kakoom,
Eventhough you are divorced, you need to fill information about your eligible children in the ds 230 form. So the case of your children is not a problem. The problem is on your marital status. You applied as "divorced" in the eDV and filled "married" in form ds 230. The information in the eDV can not be changed. What you can change is the info in form ds 230. This implies that you need to tell kcc that you are divorced and made a mistake in filling ds 230. If things go smoothly, you can then take your children with you to USA but not your spouse (or ex-spouse.) You also need to prepare a divorce certificate. Good luck.
 
Not so fast...it also depends how old the kids are...if you are divorced and you ex husband doesn't agree for you to take the kids abroad, than you will de denied. You need a letter that you have sole custody or permission from your husband to take the kids if you have shared custody...

I already sent forms to KCC but with married status, do u i need to send new Ds-230 form but saying that am single ..
 
You should sent it again and explain....but as I stated, if your ex doesn't approve for the kids to be taken abroad, than don't even pay any fees because during the interview they need prove he allows you to take them to the USA. The USA is not waiting for another kidnapping case, so you need approval from your ex!

You have 2 kids (5 & 1 yrs) and you forgot/did not fill their details in the edv? If this is the case, then your chances of getting the visa is very very very very smallllll.,
 
I agree with ammeck09.

When you send the updated forms to KCC they will go on your file along with the first ones you sent, I don't believe KCC will just throw the first set in the bin. At your interview the CO may ask you why is there a discrepancy in your information. Are you married or divorced? Do you have kids or not? Why did you fill e-DV without including your kids? Be prepared to answer these questions at your interview.

You need to care because you will be parting with not less that $1,000 of your own money. Read this section to guide you and to make your decision as to whether you will go forward or not.
13. MARITAL STATUS – Unmarried, Married, Divorced, Widowed, or Legally Separated
14. NUMBER OF CHILDREN – Entries MUST include the name, date, and place of birth of your spouse and all natural children. Entries must also include all children legally adopted by you, and stepchildren who are unmarried and under the age of 21 on the date of your electronic entry , even if you are no longer legally married to the child’s parent, and even if the spouse or child does not currently reside with you and/or will not immigrate with you. Note that married children and children 21 years or older are not eligible for the DV; however, U.S. law protects children from “aging out” in certain circumstances. If your electronic DV entry is made before your unmarried child turns 21, and the child turns 21 before visa issuance, he/she may be protected from aging out by the Child Status Protection Act and be treated as though he/she were under 21 for visa-processing purposes. Failure to list all children who are eligible will result in disqualification of the principal applicant and refusal of all visas in the case at the time of the visa interview. Call or e-mail KCC or consulate before you go, explain them and ask if it's usefull to go at all. Don't spent 1000 usd to hear "No" as your final answer....

if i played E-Dv as single but i did not include kids ?
what will happen then .. i did not include my spouse to travel with me .. i sent only one Ds-230 form for me only
but i menthioned marriedn in Ds230

Kaboom you can call them BUT I would advice you that people on this forum have called before and were told to proceed with the application only to be turned down. People answering the phones are not always qualified to give advice on your case, they will never tell you to not apply, it is not their call to do so.

YOU and only you must evaluate the situation and decide what risk you are willing to take. I am not a lawyer but I have read a lot of cases here and I must admit your case has a slim to none chance of approval firstly because you left out your spouse when you were in fact married and secondly you left out your kids. These are the two clear cut conditions for denial.

Nobody will tell you to give up, we can only point out what the rules say. How will you explain the switching back and forth about being married and having kids?

So, apart from marriage details, you DO NOT remember whether you included all of your kids in the eDV?
All info need to match the eDV. If you are SURE you stated divorced in the eDV, then go ahead and do the change in your DS 230 and send in a new one.

Next, wait for your 2nd NL. It will give in it how many kids and their names you entered in the eDV.
If those kids info do not match with your DS 230...JUST GIVE UP !!

Even if those match, with what you have done so far to complicate your case you run a risk of rejection.
But if your 2nd NL kids info are ok and you have given correct marital status in eDV (and you got a prior dated Divorce certificate with you), its worth take a risk and see how it goes.
Anyways, wait for your 2ndNL and then make a firm decision (I blv you are CP. AoS ppl do not get this info in their 2nd NL) .
