Hi everyone,

Thank you for doing a place like this.

I am applying for N400 in Orange County, CA. They received my application on March 29. I am still waiting for Fingerprinting. I requested name change. What is the regular time with name change, I mean without any problem. Are you the only person doing the oath in a court??.

-I forgot to mention traffic tickets in my application. I read in other forum and called to immigration and They said me only to put if I were arrested. I just have red light ticket ( I went to court and paid the ticket. I am going to get a certified copy), parking ticket (I have a letter from Los Angeles city regarding my payment. Do I need to get it certified too because They told me they don´t do that because it is not a court related case) and little accident in parking lot that both parts reported to insurance.
thought it was my fault. Anyway, Shoud I say that to the IO??.

- Other question: I have been without working for almost 2 years now. My wife have been working and We made the taxes jointly for the 5 years. I have IRS tax returns. Are they going to ask me something about it??.

- My last question: Do I need to bring with me marriage and child certificate? (I am applying by 5 years rule).

Some of this situations could affect my citizenship. I am in panicccc.
I really appreciate your help.
Thank you in advance

Traffic incident and car incident. Please help

Hi guys,

Sorry but maybe I put several questions in my last post in only one.

I applied for N400 and I forgot to mention traffic tickets in my application. I read in other forum and called to immigration and They said me only to put if I were arrested. I just have red light ticket camera( I went to court and paid the ticket. I am going to get a certified copy), parking ticket (I have a letter from Los Angeles city regarding my payment. Do I need to get it certified too because They told me they don´t do that because it is not a court related case) and little accident in parking lot that both parts reported to insurance (I have a letter from my insurance. It was my fault. Should I get a DMV print record??.Do I need to get a special DMV record or a regular one?)

Right now, the only thing that I have in my DMV record is 1 point related to the car accident. Should I get a special DMV CA record???.
Anyway, Shoud I say all of this traffic incidents to the IO??.

Please helpp

without working for 2 years. Is it a problem??

Hi guys,

I have been without working for almost 2 years now. My wife have been working and We made the taxes jointly for the 5 years. She has a permanent position and we had a baby the last year so I have been taking care of her. I have IRS tax returns. Are they going to ask me something about it??.
How can I handle it??.

Any advice or somebody had the same problem.
Thank you
Good luck

Last name in Tax return transcript misspelled.

Hi again guys,

Sorry for so many questions.

I requested the IRS tax return transcripts for 2005-2009. I got an account transcript for 2005 due to IRS don´t process this year thought phone. Anyway I sent them the form 4506 in order to get a tax return transcript for 2005 just in case.

Well, the thing is that I received today everything and in the account transcript of 2005 they have misspelled one word in my last name. eg. I mean John Robert - John Robirt. My SSN is ok. The other years ok.

They told me that they can´t send me another one because it is the information that they have in file.
In my return, I sent them my name correctly.

Should I have any problem with this??.

Thank you.

I doubt that such a misspelling would cause a problem at the interview. Moreover, most people are not asked to show tax transcripts at all. They are usually only needed only in marriage-based cases (in which case you'll need only the last three years) or if you had trips abroad over 6 months long and need to prove that they did not bring your continuous residency. If none of these circumstances apply to you, you are unlikely to be asked for tax transcripts by the IO. I'd suggest that you still bring them to the interview, just in case, but do not volunteer to show them unless specifically asked for.

If you really want to fix the misspelling in the 2005 transcript, you could contact the Taxpayer Advocate office, and ask them for help: http://www.irs.gov/advocate/

Employment is not a requirement for naturalization. Simply state at interview that you are an unemployed homemaker taking care of your child.

1. Name change request has no impact on name check.

In the Boston DO. the judge even does not look at those; s/he just says "approved" and then CIS hands out the naturalization certificates with your new name.

2. Traffic tickets: if your ticket was less than $500 and not a criminal issue, you do NOT need to disclose them. But if you do disclose them, you need to show certified copies of disposition, that all fines are paid, etc. Did you accident result in a police citation? Did it end up in court? If not, then you are OK.

3. Take the tax returns with you (misspelling and all). Do not volunteer them. When asked if you are owed any back taxes, just say "NO" (assuming that is the truth). If he asks for the tax transcripts, give him the last 3 years. Explain the misspelling if it is in the last 3 years.

4. Take the marriage and child certificates if you have them. No reason why they should ask for them, but why not? But again, do not volunteer them.

Good luck--you will be OK.

That's a common misconception. The guide states to disclose all citations, even traffic citations less than $500. It states that no documentation is required for traffic citations under $500.

I stand corrected--You are of course right.

First of all, you do not need to disclose your red light traffic camera ticket because it is not law-enforcement-issued ticket. It can't identify who is driving the car, only show license tag. only enforcement-issued ticket should be mentioned on N-400.

Second, about accident, Did police report the accident? And did you pay the fine that causes 1 point? Anyways, you can bring your DMV record with you to the interview.

Third, yes, you should tell IO to update the N400 only if law-enforcement officer issue you a ticket. Even accident report because you have 1 point on your DMV record (probably law-enforcement officer ticketed you)

You will be fine if fine is less than $500. No big deal if you forget to mention on N400. IO will update it. If fine is less than $500, no need to send documentation, just mention it on N400.

Hi Thank you for your answer.

First of all, regarding red light. I paid the fine. I am going to court to request a certified copy of payment.

Second, the accident was a minor crush in a parking lot. We both reported to our insurance and it was my fault so I got a poing in my record. No police involved and I didn´t have to pay any fine.

In the citation I have for automated red light camera there was a law enforment officer printed. I went to court and pay the fine and did traffic school (everything less than $500). I didn´t disclouse it in my N400 because I read that in other forums. Should I tell to IO?. Do you thing could I have some problem?

You told me that it should be better that I bring with me a DMV record. Do I need to request a regular one or special record that include this minor car accident?.

Thank you

There is no need to report accidents or red light camera tickets. Accident reports are not citations and red light camera tickets are issued to the vehicle, not the driver.
