Sending BIO Notice Means your case has been approve?

Any one have Idea--Sending BIO notice means your case has been approve? And BIO is need for sending GC?
Dose NSC send all Asylee GC? Or Other Service Center send GC.
People who got their GC they can answer this.

No. BIO and RFI are just initial phases. Every applicant needs to have their BIO and RFI(medicals,updated g-325) completed.

Once BIO & RFI are processed, your case is then in queue to be looked at by an officer who can then see if he needs any further information(RFE) or an interview or whatever.

I wish it was as simple as that.
 
BIO, at least for code 2 &3, will take your signature and picture and hence is definitely for the plastic GC card. But I agree with wantmygcnow on that getting the BIO letter doesn't mean your GC has been approved, because I remember seeing a post in this forum in which the person said he got RFE aftering doing his BIO. The RFE asked for his old copies of RTD and national passport.

On the other hand, I may have to disagree with wantmygcnow on that BIO is only an initial step. I've done some searches in this forum for the posts from the people who cases were transferred to local. So far I haven't seen any of them saying that they got BIO before the transfer. Some of them did get RFI, but nobody seems having got BIO before the transfer. In fact, for some of them who already went to their interviews, their BIO were done at the time of interview. This makes me think getting a BIO letter may mean your case won't be transferred.

But I can't be certain on this. Maybe I didn't see all the posts regarding transfer, or maybe some of them did get the BIO before the transfer but just didn't mention it. Who knows.

I think you should remember that ASYLEE GC process is a different animal by itself. Employment GC and family GC are all interviewed so they are transfered to the local office whereas usually ASylee adjustment, Nebraska adjusts them without any interviews.

I think after the lawsuit, USCIS is going through to make sure all the applications have necessary information..for e.g medicals, updated g-325 and biometrics..Since all the applicants need them no matter what. So they cant make an excuse that we didnt have this or that from the applicant.

I wish it was true that BIO means your application is approved. If that was the case then Lazerthegreat or GINO wouldn't be waiting for the special email.
An officer has to review your application no matter what..BIO is just means they have all your information..
 
Hi, wantmygcnow, first let me clarify, when I mentioned transferred cases in my previous post, I was only referring to the asylum-based 485 cases that were transferred. I did the searches in this forum for Political Asylum. I didn't search the cases from other venues (employment or family, etc). That being said, if you go back to my previous post, you will understand why I think getting BIO may mean more than an initial step.

Also, I believe I said in my previous post that I agree with you that getting BIO doesn't mean your GC has been approved. I also agree with you that there will be more review after BIO, that was why I mentioned the person who got RFE (not RFI) after bio. I'm just not sure whether getting BIO suggests an inital stage or a closer step to approval. By the way, GINO's case was transferred to local.

CIS has the authrority to interview anybody before granting residence based on asylum. Since they process everything in Nebraska for ASylees so they usually do not interview Asylees before adjustment. However they have decided to randomly interview 2% of Asylees at local office. And once in a while you are going to hear (just as in the case of Gino) that somebody was interviewed at local office. It does not AT ALL means that CIS is suspicious about the asylum claim or something is wrong with the application, its just that they choose people randomly to cover this 2% ratio.

So far we find here this forum Only few Asylee who called for Interview at Local office didn't recive their BIO. They did that on Local Office when they went for Interview.
And I think when they finish BIO at ASC that information (Pic,Index and Signature) stroed at GC Issuing Department.
All the Asylee GC come from NSC or other service center?

Well, that doesn't fit with what my attorney said. They are receiving hundreds of approvals everyday now for ND 2000 & ND 2001. It looks like approvals were granted DAYS after the bio is done. There is no officer review, if any, between the bio and approval. My attorney told me yesterday after the bio to look for within a week. Only cases need special background re-verification or incomplete docs will delay.

Hi windywd,

That is exactly what my lawyer said. Where is your lawyer, we are maybe using the same one?
 
So that means people who did their BIO will get Approval letter any days :D
And after approval letter in couple of weeks get GC--thats really Cool.

I use Frank & York, LLP in New Jersey.

I don't think it is the same one. But they are the largest immigration firm in New Jersey and has affiliates in west coast.
