Seeking legal assistance.

My girlfriend is currently an illegal immigrant with an expired visa for the last 8 years. She has been married for the last 6 months to an American friend of hers so that she can stay and work in the US legally. They do not live together nor do they talk very often. They are currently scheduled for an interview to see if their marriage is legit. obviously it is not. if they deny her at the interview, she will be deported i assume? if that happens she will get the 10 year bar I believe. so her options then are to either leave the US forever, or get married to someone else. like someone she would WANT to marry. like myself. i have no idea what I am getting into, but i cant let her leave. and if she gets deported, i will not be able to get her back into the country.

my questions:

1) would it make more sense for her to get a divorce right away without going to the interview and marry me instead?

2) if she gets denied, will there be time for her to get a divorce and get re-married?

3) how should i handle this, i love her very much. i feel like i have found my soul mate, but i am afraid of the consequences. i am willing to do whatever it takes, but would like to be prepared. Im just trying to get an idea of whats about to happen and how I can be better prepared.

any help would be greatly appreciated.

She is a dishonest B****h! find another soul mate. She is attempting to pull off a very large lie, shouldn't be a problem for her to lie to you in future. Dump her...

wow.
so is there anyone not so judgmental out there that might have some sort of insight. honestly if i where from a country with disease infested waters, poor economy ALL THE TIME, poor health care (if any at all), bugs that eat better than i do. Well, i would probably want to get the hell out of there as well. Maybe this country is filled with illegals. so what, who else is going to clean your homes, pump your septic tanks and do your dry cleaning. our econmy stays alive because of the people that are will to do more for less so that we americans can live these lives of pleasure. I am far from a person to help immigrants out of pitty, but i am in a position to help someone that i love. is that such a bad thing?

There is no telling what will happen at the interview but If I think its always better not to lie to the government because if she does get caught she will get a lifetime ban. I think she should get divorced, abandon that petition and then get married to you and start over.

i dont see anything wrong with people bad mouthing my question. I am fully aware of the situation and all its leagalities. Im just looking for opinions and ideas on the situation because i would hate to see a good person get deported for trying to follow a dream impossible to reach in her own country.

Thanks for everyones opionions and advice thus far.

That friend of yours has committed a felony by entering a sham marriage. I understand your compassion for her, but you really need to think long and hard about what you are contemplating. You claim that you love her, that is fine. Does she love you? If she did, why didn't you both simply get married 6 months ago rather than she marry a US citizen friend of hers. Your post does not make it clear, but are you a US citizen?
