Second AOS interview, no decision on the spot ideas?

We had our second interview in NY Garden City. Our immigration officer did not approve the application on the first AOS interview because we did not have enough pictures. We only had wedding pictures. (At least, this was the comment she made). We went through a second interview. They interviewed us separately. Comparing to what I read on this forum, the outcome should be positive. All of the answers match as we are really married and live together. We have no previous marriages, race or age difference. We filed the application towards the end of my H1B status which was about to expire in 4 months. I am not sure this was the problem ? The second officer said we will learn the decision within 60 days. They also explained if we do not hear back from them, we should make a infopass appointment. Why do we have to wait another 60 days I don't understand. I saw many people getting the answer right there...
 
Were you video taped? Any other issues during your first or 2nd interview?

Possibilities:

1. The IO that interviewed you might have been a junior - requiring a second set of eyes for a final decision.

2. Maybe your second interview was not as smooth as it appeared, (according to the inteviewer) hence requiring further review from a supervisor.

3. They might be wanting more time to "review" which basically means verify that your marriage is bonafide. This can be as simple as making a few phones call or as far as making a surprise house visit early in the morning.

4. They might decide to play the delay game. According to most cases I have viewed on this forum, sometimes they can delay cases for months, even years in isolated cases.

If you are not utilizing a lawyer, consulting with one at this point might be a good idea.
Most likely, everything went well meaning your GC will be in the mail soon. Expect the best but also prepare for the unknown.

yes, there was a camera and recorder device in the room with monitors. The officer did not look like a senior IO. She also mentioned she will need the approval of her manager. But I think this is a routine explanation not to give the approval on the spot. Our answers matched except some differences, but I assume they are not major faults. (3) is the worst case I guess .
 
Expect the worse and hope for the best, that way you never get disappointed. Getting a attorney involved at this point will only make it worse as they will assume you have something to hide.
Them asking you to make info pass after 60 days it seems you are in for a long haul and will definitely get a visit from USCIS. It could happen tomorrow six months from now, there is no telling.
There could be different reasons for this including but not limited to filing so close the expiration of your H visa. Did your employer ever had a I-140 filed on your behalf ?

3 is not the worst case scenario, people have reported on this forum that USCIS came to check on em and even paid a visit to neighbors so be cordial in your neighborhood.
All in all just live normally and put this behind you since your marriage is legit, and let them do what they want to do.
They are not required by law to adjudicate these type of cases in a certain time frame so there is nothing you can do to expedite this at this time.
 
Well, they did not mention an infopass explicitly. The IO told if we don't receive the result from the mail after 60 days, we can call or something like that. I don't remember Infopass. She seemed to be positive. I assume we go for an infopass if we dont hear back from them.
 
Don't let the "positive" demeanor of your IO mislead you. Namecheckvictim is correct. Prepare for the worst.

Some people will disagree with me when I say that some IO's present with a positive attitude to make the petitioner think all is well.

My IO told that my GC was approved only to get a surprise visit the following week.

Play it safe.
 
Back in 1996 my IO took the turn for the worst, after my I-751 interview in the morning, he showed up in his lunch break at my apartment which was 10 min drive from Federal building after telling me he is satisfied and the case is approved.
I was not home but he took a good look around including bedroom and the closet.
Don't believe what comes out of their mouth , it's a part of their job to show up when they are least expected and bluff you with saying that they have approved it, and that was 1996.
In a way though with all the fraud, I guess I agree with their policies.
 
We have no problem if they would like to visit us in our apartment. TripleCitizen: I am not from a country with high rate of fraud or immigrants to US. They still give DV lottery GC my country. Thanks for your comments guys. The IO did not make any comment about the approval or denial but given the very specific answers we have to the separate interviews. They should be convinced that we are really married.
