Hi Jay,
My lawer got a confirmation from OR SESA on Aug 13th. She said that it would take 4-6 wks for DOL to send RD. In that case would the DOL RD be Aug13 (= or - 3 days) or the 4-6 wks.
FYI: I still have'nt heard from my lawyer about the RD. I plan to call her early next week.

The beneficiary of an I-140 or I-130 (with a current priority date), who has been delaying pursuit of the green card for any reason, is advised to reconsider filing before the priority dates start to retrogress. An individual with a pending I-140, particularly one in EB3 who did not file an I-485, may wish to file now rather than wait for a potential retrogression. The potential retrogression will need to be considered when deciding whether to process a case as an Adjustment of Status (I-485), or through consular processing for an immigrant visa. With the I-485, one is able to obtain an employment authorization document (EAD) to work. With the Consular Processing option, one is generally able to obtain permanent residency more quickly, but the applicant and spouse will not be entitled to EADs.

While no immediate retrogression is expected, January 2005 is only three months away, and it can take time to collect proper documentation and data. The severity of the impact in employment-based cases will depend upon the cut-off dates that are established.
 
I can't understand this.
My RIR was submitted to SESA in WA state in April 2002.
It has been transferred to DOL in May 2004, and it is still being processed.

How come yours was started in Oct 2003 and it is already approved ???!!

No Progress

This is the 2nd week that the IVR mentions April 2004 as the current processing month. But, despite that, it appears that we have seen no movement against JayJo's inventory of petitions. This is very odd.
 
Case #

No, I did not. My HR called the law firm dealing with my case to find out what my number is. The firm would not divulge the number to my HR. The law firm's response was that they have a policy not to release the number to the applicant because in the past, applicants have taken the number and made enquiries about thier case to the government by calling INS/LC employees directly which had a negative impact on thier case.

Despite me assuring my HR I only plan to use it to poll the AVR system, my HR felt they could not do anything further because the policy is not their own, but rather the law firm's policy.

By looking at the above data that i collect through the AVM, #GCSync(03/08/04) case is certified

Jayjo, you are doing an excellent job ! That kind of update is extremely valuable.

So, based on what I see, I guess they have not gotten to looking much passed his date.
 
Assumption

Jayo, I'm assuming that my case #'s prefix is "9579" because of the other person's on your inventory list who has the same receive date as mine. Given that, and the results of your list, I wonder if any dates beyond the 03/10 have been processed....

The Last case that was certified with RD is 03/09/04 and system update was on 09/23/04. That is the Last System Update date that i hear from AVM. They might me working on 03/10/04 cases and AVM system may not be updated.

Let us wait and see
 
AVM inconsistent?

Hi,
Couple of days ago the message on the AVM said that they were processing cases in April 04 for all states except CA. Any idea why the inconsistentcy.

They seem to be taking resources away from Seattle queue and putting it on SFO queue.

With all the hype about running out of immigration visas early next yr, it seems unfair.
