I came home happily today, and almost had a heart attack after opening this email from my attorney:

Funny thing is that I paid for $7,000 dollars to become legal using 245(i).

I-485 ND: 9/17/02
EAD ND: 9/17/02


The government issued a new regulation according to which the nationals andcitizens of certain countries have to register at the district INS office. Here is some information about it:

On December 16, 2002, Notice was published in the Federal Register requiring certain nonimmigrant aliens to appear before, register with, and provide requested information to the Immigration and Naturalization Service.

Any persons meeting all of the following criteria shall, on or before
February 21, 2003, appear before an immigration officer at any of the locations listed on the
following pages:

You were last admitted to the United States on or before September
10, 2002 in a nonimmigrant classification; AND
· You are a male born on or before November 15, 1986; AND
· You have not applied for asylum prior to November 6, 2002; AND
· You are a national or citizen of Pakistan, Saudi Arabia and Armenia.

Persons holding dual citizenship also must register.

All persons required to register must answer questions under oath before an
immigration officer and present documents, including passport and the Form
I-94 issued upon admission, and any other forms of government-issued
identification; proof of residence, such as, but not limited to, title to
land or a lease or a rental agreement, proof of matriculation at an
educational institution, and proof of employment; and any other information
as is requested by the immigration officer. The immigration officer will
fingerprint and photograph those who are required to register.



Because you are out of status at the moment, but in the process of obtaining
permanent residency, you will be taken into custody and put into deportation
procedures. You case then will be forwarded to an immigration judge. You
will still get your permanent residency, only it will be through a court
hearing.

What should I d0? Because if I comply, I'll be taken into custody.

If I don't comply, is there still a chance I will get my i-485?

Well, our lawyer told us (Expired i-94 for about 6 years). But some new evidence is coming up that we may not be screwed..

Here is the thing, that our whole family had abandoned the Pakistani passport a few years ago, and we all got Swedish citizenship. So we are checking if these laws still apply to us.
 
Unfortunately, in all immigration matters it is rarely country of citizenship, it is country of birth! If you are born in Pakistan then you WILL fall under that category, your passport has nothing to do with it. But on the other hand if you were born in Sweden but received Pakistani citizenship by virtue of your parents being Pakistani, then you are okay!

Hard luck, about the new ruling, but I think you should be okay. After all the 245(i) was implemented to legalize illegal immigrants (and to obtain the hispanic vote) but since it applies to all illegal immigrants you should be fine. Sucks that your life is being affected by Mr. Osama but technically you are legal at this point of time. So I would suggest you comply with the registration requirements, offcourse with the proviso that you consult a lawyer like you no doubt are doing right now. After paying 7000 $ you can definitely expect some service. :)

Do keep us posted on this case. I am sure there are a number of people in the same situation and this will help them immensely.

It is not Bush who screwed our life, it was those islamic terrorists who screwed all of our approvals. They will definitely go to hell for not only for killing so many innocents but for putting all our 485 applications in peril.
 
So what's next?

Not that I'm dishing my ethnicity, but it would have been better that INS would not have to know.

I'll defintely keep posting my desperate attempts to get legal. :confused:

Anyway, we talked to the lawyer today, and she said she had to talk to the attorney. However, she seemed calm and claimed that there is nothing to worry about.

No it was bush and his stupid administration. The terrorists did their job by destroying the towers, what really damaged america more was the paranoia that followed. Yea they need to go and kick butt, I understand that, but in the process if they need to block 101 for 5 hours because there is a cardboard box on it, I think that is unacceptable.

Y'know their admin is just plain stupid, they Xray the shoes of a 86 year old lady, while this 7 foot tall arab in a strange interest in a fuel tanker does what he wishes.

Similarly, they grant visas to mohammed atta and party, and we here are put through unreasonable laws and regulations that add to nothing but headache for both INS and us. And yea, did I mention, Immigration made this country, a bad immigration policy could certainly hurt this country a lot.

But Bush/Ashcroft/Rumsfield are busy making it worse with DHS.

is this true? I hold dual citizenship and haven't received a notice, should I inquire about this or just leave it?
 
.....never mind.....went to shusterman to read the document.....it's only if you have a citizenship in one of the affected countries
 
Terrorists did what they wanted to do. The US govt is doing what they wanted to do.

This administration and its politicians had a long time goal of hitting hard at the immigration - both legal and illegal. The sept. 11 gave them the perfect chance to fulfill their long coveted dream/goal - to slow down/discourage and eventually almost stop immigration to this country. They want to retain the purity of their nation - christian and white-european race - of course a bs idea at this new age.

Immigrants by a large percentage always vote for the Democratic party bcz of its liberal views on immigration and other matters.

Republicans had always hated the immigrants for this reason. What can be a more perfect opportunity than the cause of national security to stop/slow down immigration into USA. The opportunist anti-immigrant and rascist groups had jumped on the back of national security and started their mission under the cover of DOJ, DOS and the admin. The records of these people - Asscroft/Lott/rumsfeld/pat-robertson/jerry falwell/charles-heston/pat-buchanan/bob-bauer/others - tell what they are.

As long as these people are in power, GOD knows what lies ahead of us!

This is an immigration message board. Lets keep the politics out of it. If someone has to publisize their political agendas, they should go to VHP or Jumat Islami message boards.
 
I think the the statement was attributed in a different meaning and not to offend any nationals.

Coming to SillyMan's point, it was the terrorists who started this had there been no 9/11 we would have got our approval by now right? Where it all started? Who started this? Who gave a handle to Bush to go slow on INS? Had there been no 'Godhra' there would not have been any 'backlash' right? I would blame/curse/hate these terrorists first before blaming Bush and company. They are solely responsible for the delay in all of our approval now. Let us blame the culprits in the order.

I also love to hear other versions of explanations to this tormenting behavior of INS. The purpose is to let everyone inform and be informed of different forms of explanations - not necessarily I have to agree to all of them.

Anyway, I am not a pakistani - sorry to tell you that. Although I believe, calling someone by name is dead wrong - be it pakistani/others.

You missed the whole point. My response was not intended for you (I was responding to greenpeace's message). I was merely discouraging any politicaly motivated insensitive comments.

Coming back to the real issue, I see that INS has subjected innocent people to longer than normal delays and in most cases jeaopardizing their future but can you blame the government? INS has screwed up and issued visas to several known terrorists including sept 11 suspects. I mean how could the visa issuing officer have missed that headline? I mean the name Mohammad Atta should have atleast raised a red flag. As a result they have to be extra careful as to who they should issue residency. Its not fair and it sure tests ones patience but then again life is not fair.

Call me a pessimist but I dont think that writing letters to senators or writing to the newspapers will do much good. If you dont have a vote, the senator doesnt give a hoot. The government will do what it has to do even if it means us waiting another year for GC or even getting laid off and having to pack up. It really doesnt bother anyone in Washington under current economic condtions.
 
Pappoo, Damn you are a pessimist. We're not screwed until we think we are. I am sure writing letters is better than just sitting on this board saying "we're screwed".

But yea times are harder than they used to be, but together we'll be able to see thru this.

Worst case to hell with it, we'll go back home. But atleast we will have the satisfaction to have tried in earnest. Or one day late in our lives we'd be wondering ... if only we had tried that day, that is today. I'd rather try even if it means banging my head on a steel wall.

It sure makes for a good motivational speech. If you think it works, more power to you... keep up the good work. Dont get me wrong, I am not saying we shouldnt write the letters etc. I have done it myself. I am just saying will it work? Call it a pessimistic view or a realistic one but the bottom line is that the government is determined to change the way INS operates and rightfully so. Its just that people like me whose GCs are in process have to pay the price. As far as the politicians go, they will tell you what you want to hear as long as you are willing to pay for $150 a plate dinner to their fundraiser. I am just hoping that this saga ends soon.
 
if you want more sick news go to http://www.aila.org and read about the special registration experiences. Pakistani or not, this is not right. It is almost certain that other countries will be added to the list; eventually everyone perhaps. This is another slower-downer.
