Scary Info from VSC Cus. Rep. on my 485 case - Trust or not!!!!!!

HI Gurus,

Need experts advice on my GC case.

Please see my signature for my case details.

I talked to VSC Representative about my 485 case status. She was very polite but gave a very scary information. I filed our 485 (myself and wife) on May26, 2004 and I am seeing numerous cases getting approved that are filed anywhere from Mar 2004 to Dec 2004.

When I talked to this customer service representative, She said that they received our FP results and our Name Check process is also completed. The scary part is that she said that our priority date is May 26,2004 and they are processing the applications with PD of June 2002 (EB3 cat) and the visa numbers are not available now. So, it will atleast take a couple of years before they touch our 485 applications.

Gurus, Is this true? if So, how all others who filed in EB3 and in 2004 year are getting approved? I told her that I am already seeing many approvals of EB3 category filed in 2004. she gently gave the reply that she has got no info about that but she said that our cases were moved to retrogression process and it will take a long time before the officers touch them.

I am really frustrated with this GC process (Not that because of time length but it is because of my employer). My employer (working as permanent employee for an American Company) is really exploiting me. They know very well that I will not leave until my GC is approved and they are not increasing my salary at all. All the empoyees get a standard 5% increase every year where as they gave me 3% increase in the last 5 years. They did not increase my salary for two years and they give all stupid reasons (Like no budget for team and no budget in the company...blah..blah..) I argued with HR many times but all those gone invain.

I am just waiting for my GC to be approved so that I could change my job but today I am really frustrated hearing the representative words.

What should I do...Gurus?
Should I file AC 21 and change the job or simply wait for the 485 approvals?
I already posted my story in this forum about using AC 21 but majority of the people asked me not to use AC 21 unless it is required but now Is it really worth of waiting for two more years in this company or should I simply use AC 21 and change the job?

Please, Gurus, advice me.......
 
Are you from India, China or phillipines.....if thats the case, you might have to wait for some time since your PD is SEPT 2002....and they are processing june01 right now....you can always use AC21 to move on....atleast you will make more money..

Your priority date is not May according to your signature. I suppose it is some where in 2002. Check your 140 approval for PD. If it is not less than June 2002 then you got to wait until it reaches your Priority date.

No!

your PD is september 2002. In another 3 to 4 months when PD moves past SEptember you will see the approval. Till then bear all the problems...do not file AC21 or take some other action. It is just around 100 more days wait. All the best...
 
Don't worry as from your signature, I'm sure your PD is 2002 so your time is coming! And as your I-140 has already been approved so you may want to change employer as soon as possible, as once your GC is approved and you're staying with the exploiting old employer, you'll have to stay with it for another 6 months. So better solution, use AC21 and switch asap!

May be your PD is messed up...

Reading from your post I feel your PD is set to May 04 rather than Sept 02. Get it fixed with the help of your attorney and you should be okay. Check Murthy.com and there is a small ray of hope that the PDs will be be advanced very fast... other than that I don't see anything to be scared or worried about.

VSC Rep gave wrong Info....

I talked to my attorney about my PD and the conversation went between me and VSC Rep. She said that the Rep. does not have any idea of what she is talking and she gave me the wrong info.

Attorney said that my PD date is Spet 17, 2002. She also faxed me my 140 approval notice where it is clearly written my PD as Sept 17, 2002.

Guys, Do you think that the VSC rep has mistakenly told me incorrect PD or is it possible that my PD in VSC system is May 19, 2004 and the PD on my 140 approval is Spet 17, 2002?

MY wife called VSC today to clarify our PD date but the representative asked her not to call that number as it is only for Emergency cases.

Should I take this as VSC Rep's mistake or call them to clarify my PD with VSC rep once again. I heard that they log the calls and its not good to call VSC frequently.

worry about Name check?

You should worry about FBI name check? That is the killer in the I485 process. Follow the FBI name check threads and follow up. And further take help of congressmen ( after the I485 processing date goes past your I485 date).
 
I have to ask - why are you freaking out about this?

You know your PD is not current yet - why even call up? At the earliest your case will be approved when the priority date is after September 2002. If you have to wait for bit after that - well, just wait your turn, or wait and see if other people with priority dates of Sept 2002 are getting approved, and just wait your turn.

No offence, but clogging up the lines with calls that you know the answer to (after all, your lawyer showed you proof of what's in VSC's systems) is not going to resolve anything - its just going to make it harder for poeple who have genuine problems to get answers.

The PD on my I-485 receipt was the same as the receipt date, but that's just the receipt. Ultimately it was recorded correctly without my doing anything.

It is always safer to assume that the rep on the phone is incompetent. That is usually the correct assumption.
