No News Yet from Employer/Attorney.

My case starts from 0958**** so guess have to wait a little while.

Actually the Received Date is 2003.Sorry it was a typo mistake i copied all across the cases the same 2000 year instead of 2003.
the Info is same where Raj and every one used to collect from AVM.(415-975-4617)

My case is also skipped. EB3 with 1 year experience.
How long does it take to get 3 option letter ?
 
Changing jobs and labor cert - very urgent help needed!

I hope some of the gurus out in these forum could help me! I can't get a straight answer from my lawyer...

my LC is pending (at SF) for the last 3 years (PD: Oct 2002), and my 6 year limit on the H1 runs on on May 2006 (10 months away), I know I could extend the visa it on a yearly basis until GC is resolved, but what happens if I want to switch jobs right now - would I be able to start a new GC process at the new employer in my 6th year? will it be possible to use the original PD? could I then extend the new H1 past the 6th year? the new employer is well known and does immigration processing for thousand of people each year.

Any help would be appreciated as soon as possible!!!

It was always my understanding that you have to start again from scratch if you switch jobs. I think the only way you can transfer an application is if you are already past the DOL stage and have had the final stage of your GC application on file for 120 days. Perhaps others on here can confirm or deny this, as I also can't get an answer from my attorney!!!! I'm in a similar position, except that I've already extended one extra year past my 6 years H-1B, and I'm going to have to extend again this summer, as I'm still stuck with all the other April 2003 cases that have been skipped at SF DOL.

Unfortunately my case got skipped(09560323).My lawyer made me so confident that my case will be certified as our company is a very small company with no layoffs.And also my collegue labor with my employer got certified with no querys.Do you thing they are going to go back and review the earlier cases or they might have issued a 3-option letter.How manty days i can wait and ask my Attorney to follow up my labor application.Still there are more approvals.I didn't checked anymore cases after 4/18/2003.

Also is yours EB3 or EB2 ?

I want to know whether all EB3 being skipped or its random and that might happen to EB2 as well.

Mine is Eb3 with BS+4 years experience.and my friends is also eb3.But both of our Priority Date are same April 19,2002.Some how my received date went to April18,2003 where as my friends Received went to March 10,2003. My friends labor got certified in October 2004 .

That means he is not in April 2003. It looks like unless someone confirms that EB3 cases are being skipped. Can someone confirm if any EB3 one with RD between 11th April 2003 to 21st April 2003 has been certified recently.

get_me_green, you are right. This PD June 1, 2002 or before applies to India, China and Philippines. Other countries can apply for conc I-140 and I-485 until June 30, irrespective of Priority Date.

Yes, you can apply for concurrent filing of I-140 and I-485, before June 30, if you hvae or will have a certified labor by then. Other wise you can not apply for I-485 from July 1, until atleast Sep 2005.

For those who have applied for I-485 in EB-3 (whether it is concurrent or after I-140) whose case do not get approved by June 30, will have to wait for the dates to become current for EB-3 to get I-485 approved. After June 30, no EB-3 I-485 case will be approved, until atleast Sep 2005.

Please help: lost I797 - H1B approval

HI, guys,
I probably lost the orginal I797 - H1B extension approval letter. Just wondering is there any way to ask DOL to re-issue one? Can I do it by myself instead of through attorney?
Please let me known for any hint, I am planing a visa stamping in next few month. Thought put such important document in the saftest place...
