Well like you've always said, keep the faith, stay positive and don't despair. It is so amazing of you to still check the AVM for us even though your case isn't even there! Same for Raj whose case was skipped.

Raj, I heard from my attorney this week that the skipped cases are probably because there are several people processing cases and it seems like some are slower than others. There is only one certifying officer though. So I guess that means that if your case is skipped it doesn't mean you won't be certified only that it may take a little longer.
 
Confusion 140-485

Hey GP111 and Gurus,

I have the following question. Slightly out of context of the tracking process. But an answer to this will relieve me a lot.


My Details:
PD:05/13/2002
RD:04/24/2003
Case #098560xxx

Hopefully my case will be cleared in month or two and if dates won't retrogress I will be able to apply for 140/485.

My question is: My wife recenlty graduated and I would like to apply for her H1. I believe that the newly allocated 20,000 visa for masters from US univs are still available(It may be over soon). A consultant is willing to apply for her H1 but may not be able to place her on a project immediately. This means that she will be on H1 without pay, in the worst case, up until I apply for 140/485. Would this be treated as "out-of-status" for not having paycheck and being on H1 or the 485 will be adjucated on the basis of my file.
Should I have to provide her paychecks as part of the documents if she is on H1 when we file for 485/EAD/AP.

I am planning to do this to offset any delay in acquiring a EAD so that she can start working as soon as she lands on a project.

I am still wondering, they are skipping lot of cases. Any clue, why they are skipping these cases. So far, we have not found any reason other than some guy's said their cases are filed in EB3 but not sure...

I have two questions:
1. can my employer make me sign something to make me stay with them for a period of time, so they start processing my green card. My supervisor insinuated something like that.

2. When can I apply for my green card, I read in this forum that we need to wait until September. I won't be able to apply this month. Is it true?

Yes, They can do that (kinda like if you leave before 1 year you pay for the GC expense etc..) Also you are obligated to work with them for some period of time after you get your GC. BUT you can always use AC-21 to change job after 180 days of applying I-485..In california you will get your GC in 180 days !!

No, With PD of April 02 you can apply I-140 & I-485 concurrently now.. If you are EB-3, do not waste a day & apply before June 29th.. IF you are EB-2 you are file atleast till July end & may be later also.

My friends case was skipped last year, and we found out that it was remanded
back to state

Thanks to all of you for your efforts.
My case (April 16th 2003, EB3 with 1 year Experience) was skipped recently. I contacted my attorney. According to her she has other 14th April cases which are not cetified yet. But she has no answer to why the cases are being skipped. Only way is to wait.
It is very frustrating to wait in dark.Any efforts to find out as to what is hapenning with skipped cases will be very much helpful. Thanks a lot to all of you Gurus.

I would be very surprised if they make you sign a contract for filing your I140 and I485. i think its prudent to wait for some time with ur employer after u get ur green card but I think you would be able to challenge such an agreement in the court and win if it comes to all that. I dont' think you can say no i won't sign it because your in a difficult position, but in all fairness they will be as guilty as u are. :) so try to see if you can get it via some email communication which will show that you were essentially forced into signing the contract. and then after you get your GC in 6 months you can say namaste to them and move on,

I did not find any "remand cases" recently. Only certified or skipped. MAybe it is a small good news. :)

A question about Labor C

My company may be acquired by another company. May I apply PERM now?

What will happen if my company is sold before PERM approve?

May I use current company's PERM and apply 140 & 485 in the new company after current company is sold.
