Hello,

I recently got my labor certificate approved (my PD for federal was March 27th 2003..In January I got NOF, my lawyer replied and finally I got my LC two day days back )but while applying for 485 I am facing a big problem..Birth date on my passport and my original birth certificate is different..I used to think I will use cert. issued by counslate which is based on passport but lawyer said it is no good.. With impending retrogression in EB2 and other concerns I do not want to wait for long in applying for my application. Will you please guide me what are my options.. How should I handle this case..

Try to get a non availability letter from the concern government office and get two affidavits from your parents. you can produce this in lieu of birth ceritificate.

if you have received the birth ceritificate already and if you cannot get non availability letter then go with legal action to change your birth certificate date as per your passport date. Your parents can go through magistrate and prove that your birth date is as per passport date by providing your some certificates. Then the magistrate will order to put your change of date information in newspaper and in some notice board. if no objection from anyone then Magistrate will recommend to the concern authority to change your date of birth as per the date you applied and issue a new birth ceritificate. i think this will take at least 1.5 months to 2 months. you can ask your parents to contact some lawyers who are specialist in this field.

I was wondering, whether my HR should alos reply to the 45 day letter. The letter is originally written to attorney, and a copy was sent to my HR.

Still they are processing RD 03/31/2003. My case # 09553728 RD 03/31/2003, but still having the "received" status in AVM. . They cleared upto 09553793.

Also my co-staff having case# 09553488 RD 03/27/2003 in pending.

Are they doing any research on our applications?

Thanks Rajmahal for the update. I get a feeling they have started going slow on 999.151-031 again, lots of these are still pending from 3/24,27,31. What say all?

My company won't reveal that information to me.

received 45-day letter

Received my 45 day love letter too. FWIW, the letter reached my office on 3/14 though the date on the letterhead was 2/23. Back to waiting again...

I have not recd. my 45 day letter yet.But according to my attorney friend , the BEC should send the 45 day letter by February 28 and the processing would start during first week of April.
