Thanks Gp for clarifying. The AVM also says the same thing.i.e., if it upto APR-03, remaing reginal cases will be processed in SF DOL.

Letter from Phily

My lawyer today said she got the letter from Phily. RIR, California. Case #P-04293-XXXXX. Case got trasferred from State to Federal on Jan 12th 2004.

received 45 days letter

Hi:
My employer received the long waiting 45 day letter today and I got a copy, the new case NO is P-04308-331**, the interesting thing is that I got my case NO from Dallas BEC by status inquiry with D-04308-331**, the letter says my company failed existance check, although my company is a public company in NASDAQ, Attorney will take casre of it.
It looks Philadelphia BEC start sending letters for CA RD May 2003 cases.
PD CA 06/11/2002
RD SFO 05/01/2003.

eg:Lets say they start PD-07/02 wihch is top of Q as first case and has recieved reply and all documents are in place will be started processing first.
Later if they recieve PD06/02 reply, then this case will jump to First of the Q as a next case in line. Similary if they recived PD05/02 case reply then this case will take the precedence on all cases even though the reply was recieved as last.

However you see some overlaps based on PD's, considering no. of people working as analyst but this may be negligible.

Another thing to notice is that even though u dint recieve your letter for various reasons (software/printing/blah,blah,) your case was entered in the system on 320th day and has earlier case No. comapred to mine. Which means while entering the data they must have fallowed based on earliest PD which were transferred to BEC.

Only question still unanswered is why everybody didnt get the 45day letter?
 
I sent the email and got reply from Dallas BPC with New Case #, but No 45 date letter yet.

As always, DOL continues sending confusing messages. In

It is said california cases should be directed to Dallas BEC. However some CA folks, including myself, got new case No P-04xxxx-xxxxx, which is interpreted to be in Philly. Any one has any idea what's going on? Or is there any one received 45 day letter from Philly?

Although DOL claim there will be a single queue for 2 BEC. I strongly doubt it, since technically it's more likely Dallas and Philly will eventually maintain their own FIFO once they start processing. I wish my case in Dallas, I really scared to see huge bunch of NY cases with PD as early as in 2001.

The information (Case transfer schedule / state wise BEC) is for Cases pending in SWA NOT DOL... SF DOL has already shifted 10K to Philly & 10K to Dallas...

AEC/RIR or PERM - which is better for filing new labor?

Hello,

My company is going to start green card processing for me and my family.
Now what is the better way to start ? Should I apply with current AEC/RIR
process or is it better to wait few more days and apply with PERM ?

My case will be filed in San Fransisco.

All Fed regional DOLs closed?

seems like all fed DOLs are now closed.

Are the BECs sending out 45 day letters based on PD (Priority date the application was received in the State SWA) or the RD (Received date the application was received from the Fed regional DOL from the State SWA).

Up until now, only a few cases from heavily backlogged fed DOLs have been sent to the BECs but now that all of the Fed regional DOL cases have been sent to the BECs, it is only fair to process according to the PD. And 6 week processing time for a PERM application just insane compared to the 24-30 months projected wait for the LC applications.Obviously the DOL is begging for a Lawsuit !

Any insights anyone?

Dallas enquiry

I got a response to my enquiry from Dallas. They provided me with a new case number starting with P-04320....(note P). I recollect someone had deciphered what these numbers stand for:

the first 5 numbers is the Julian date that your case was first entered into the PBLS data entry system (301st day of 2004 or sometime late October). The last 5 digits are assigned by the PBLS system to cases in the order they are entered system-wide. (Example:04301-00100 might be entered in Dallas and 04301-00101 might be entered in Philly).

If this is the case, my application entered the database in November 2004. Then why the delay in sending out a 45 day letter for my case? I note a person whose data was entered in Jan 2005 has recd the letter! Any comments?

But I have a question ... the website says ... "Permanent case applications currently located at the SWAs and Regional Offices are being shipped to the Backlog Processing Centers in three phases based on local office receipt date." ... which includes the regional offices. How do you know that the SF DOL will continue to work on Remaining Regional Cases?

There was a Memo published by DOL in last Nov that SF & NY DOL will continue to work till end of Dec-05.. You can search sites like www.immigration-law.com or www.murthy.com .. Also as per their first transfer schedule SF DOL was one of the first DOL to send 20 K cases to BEC (RIR from MAY-03 onwards & Non RIR from OCT-03 Onwards)... remaining cases to be handled by SF DOL before end of 2005.

The New York and San Francisco Regional Offices will not close until at least January 2006. These two offices will continue to process permanent labor certifications until that time. The DOL is working to integrate the computer systems of all offices into a uniform national software network.
