oracle & peoplesoft merger impact on pending LCs

What will be the impact of today's announced layoffs on pending cases of those employees who will be lucky enough to survive the soon imminent massive lay-offs? Will the pending cases be rejected, get remanded to state or get processed normally?

PS - We are missing gp111, but great job mnhrdc & all in the meantime!

Looking for a employer who can sponsor GC immediate after hiring

RIR LC between Jan 1, 2005 - March 28, 2005

Friends,

Applying for labor certification in RIR in a day or two...where one should be sending LC application? Is it to NPC or BEC or state labor department?. Is there any change in RIR case processing rules between Jan 1, 2005 to March 28, 2005? Would like the application to be sent to right place.

Just send it to SWA, of your state in turn it will routed to NPC

Btwn you can opt of PERM if you can wait upto March 28th 2005.
Is there any reason you are opting for regualr processing instead of PERM.

We are in same boat , we havnt heard from BEC for the months of May,June 2003. We dont know but it may be processed at SFO, if so do the math for April,May,June, It just took around 4 months to complete for March 2003 (RIR) cases.

Who survived Tsunami effect at pleasonton requires there Appln amended refelecting there new employer and willingness to continue.
But think of those who got effected by lay offs realy have bigger problems who are at advanced stages, need to start afresh if threre cases are withdrawn.

has anyone heard anything about the remanded cases ? My case got remanded back to state in June 2003 . I have not heard anything yet .
Let us know if anyone has any kind of updates about this ?

I am totally confused with the current procedures and postings related to PERM rules and current processing times for labor at BRC's etc.

My case details:
H1B (Currently on 8th Year Extension)
PD May 8th, 2002 (CA SWA --- RIR/EB2).
RD May 1st, 2003 (CA DOL).
Recd BEC Letter: Dec 29th, 2004. (PA BEC)

How does this PERM impact on my current processing time?
Are there any benefits that I can avail from this process PERM?
Is it good to Convert my current application to PERM or just keep as it is?
If I like to convert, what is the process and how long does it take to get approved?
Am I going to lose my PD if I convert?
Any ideas on when the BRC's are planning to start approving the LC's?

Please share your thoughts on the above questions.

My case was remanded back in May 2003. I haven't heard anything from my lawyer. When I called the Foreign Labor Certification Office, a lady picked up the phone and said that all cases are being moved to Dallas BRC/BEC by March end. Has anyone in remand case received the 45-day letter ?

Anyone cracked the mystery of how these letters are being sent out? To me it appears not by company name or by PD..... They must've had some filing system for sure and that will give the clue as to what order our files went into the boxes sent to BEC. Could it be that only EB2 cases are getting the letters???

Excerpts from FAQ at DOL site regarding BEC centre
Some of questions answered what happens at BEC if your appln is trasferred or under Transfer

How state cases go to Bec centre

As described in Task 4, the PCC will be responsible for collecting and
transporting the applications from the SWA’s to the processing centers. The
SWA’s will place the applications in boxes for collection, and affix shipping
labels depending on the PCC’s procedures for collecting applications.


What they do after reciept

Is it necessary for all applications to be transferred at once from all locations at
the beginning of the program, or in phased shipments over the duration of the
contract?
a. DOL anticipates that shipments will be phased to the extent necessary to
maintain an orderly process, however a sizeable inventory as described
above is also anticipated. DOL’s objective is to have the applications
transferred to the processing centers as soon as possible after start-up.
This will enable the PCC to start data entry and send out initial letters in a
timely manner.
This is important because of the relatively lengthy cycle
times involved in some of the application processing. As noted in the scopeof-
work at Task 5, a sufficient number of applications should be in the
database in order to test processing initiatives and team approaches
. As
also noted under Task 5, DOL is interested in offerors suggestions and
recommendations in this area.
The RFP states that "the PCC will be responsible for collecting and transporting the
applications" to the processing centers. What does the ETA envision is entailed in
the collecting activity?
a. The PCC will arrange for collection of the boxes of applications from the
SWA’s and transportation to the processing centers. The PMSC will assist
the PCC in coordinating with the SWA’s. The locations and number of
applications to be collected from specific SWA’s will be finalized during the
60 day implementation and start-up phase - Task 4 (d).

How they enter form 750 Froms
Is DOL open to digital scanning of ETA 750 forms - including OCR/ICR and other
recognition technologies?
a. Yes, DOL will consider any proposed process improvements that can be
demonstrated to improve timeliness and cost-effectiveness of application
processing and is consistent with law and regulation.

How much time to expect when they start Processing

Approximately, how much time did it take TMS to process a Basic application
during the simulation?
a. The length of time required to process the average basic application ranged
from 150 days to 200 days.
Approximately, how much time did it take TMS to process a RIR application during
the simulation?
a. The length of time to process the average RiR application was less than 60
days.

What order they process at BEC centre (FIFO)
161. Is processing the ETA 750's by the oldest date still a requirement?
a: Yes.

Hi, sr1234,

I learnt from previous post that the latest case which was certified was # 09553528 (rec'd 3/27/03). I guess cases from # 09553528 (rec'd 3/27/03) have not been certified yet if you can check.

By the way, can you let us know who to check cases status except the DOL phone. I know # 415-975-4617 is down.
