Hi there !
Here we go again .
My lawyer (this one to) i think missed again (sopposedly is top notch) ....He said to me that he have to negotiate ore something like that my case, ore we have to start again and file for Supreem court....gggrrr I dont care for $ (which I do ) time ore whats so ever... I just care for all this big deal, it's eating me inside.
I filed for EAD card which I dont realy need, and got letter that my case was transvered from NY to Nebraska and I stil got nothing, after 4 month.
No I am asking you respected members of this auditorium......what should I do ?? ........Is going to happen something with ammnesty, ore should i just do which many athorneys telling me .. wait and something will happen, which I cant do that

supreme court? You mean the court of appeals has denied your case and you are trying to get the supreme court involved?

Well, in general the supreme court will not review an asylum case unless (1) you present a significant legal question (i.e. whether they think you have been telling the truth is not a legal question and that does not concern the supreme court) and (2) that legal question has split the various circuit courts below.

For example, the Supreme Court had previously decided on the burden of proof an asylum applicant needed to meet (a pure legal question) and whether imputed political opinion was a viable basis for asylum.

go for it...I remember a case of kenyan citizen denied asylum despite his wife was rapped..anyway he took his case to the supreme court and he won it.
I listen to his story through NPR program.
 
OW ,I just spoke to my attorney ,he said to me that last Thursday he spoke with court, its called camp meeting ,supposedly to settle the case ,but they did not give him decision...
The guy is crazy, ore thinks that I have very low IQ , he never did nothing , there is no productivity that I can see....Now he told me I need to pay him $10.000.00 in order he to file brief which it will take him 30-40 hours , so now we have 30-60 days to file brief .
If I don't pay it will cost me much more to hire new different attorney , and which non is better than him . he thinks he is the best but again there is no progress.
If I don't pay he said they will come and pick me up that's what agents from INS are doing now going to houses and pick in up people and deporting..
And I file applications for EAD twice ,nothing ....second time they send letter for fingerprints and to inform me that my case was send to Nebraska ...and I still got nothing.

Well I hope I will hear some good news ,,,,ore advise here from you lady's and gents.

To which court will the brief go? Please be specific.

First was in front of IJ..Denied
than to BOA..denied "afirm without opunion"
Than motion to reopen..Desnied
than hi said this one (last)was to setle the case..he is waiting for answer.

Yes I do feel like some moran, I maybe bring TV and news paers there in his offis I work for them ...just witing to make it shore.
What about ammnesty ??

Let me ask the question again. Is the case pending before the Second Circuit or has it already been denied by a Second Circuit panel?

I think his case has been denied from every court and the lawyer wants to file in the supreme court(highly unlikely to be approved). If he doesn't, a deportation order is issued and INS agents pick you up from your home.

I have been trying to get him to confirm that and he has not done so.

As you pointed out correctly, he has a higher chance of winning the lottery than having the Supreme Court accepting asylum his case for review. If the case is still before the Second Circuit, he faces an admittedly uphill battle but still has a fighting chance with good legal representation.
 
Well he said to me , last Thursday he had camp conference to settle the case, but they did not give him answer yet.
First motion to reopen was denied, and this time is that he had camp conference to settle the case . he is telling me nothing.
He said that he sand to me all papers in certified envelope but I got nothing and I was in the post office, nothing was delivered ,and there was no mail ,and nothing to be delivered to my address...
I just know that there are many clients of his that are not happy with him many of them . should I get wired and go in his office and next day get him on TV and News papers and disbar him . Hi is not answering calls to clients .
I being told not to give him money . but I did . hi is not even talking to me.

I talked to other attorney , and hi said to me that my present attorney have no good reputation and he cant take his case ,,,,,also told me that , INS will first send latter. than I have to go there and they will tell me that I have to leave the country...it will take round 6 month....and said to me that definitively not to give no dime to this guy... and Should not wore that much ....
So wantmygrcard you should relax , it appears that you are getting so exited .I am now asking if some of you know some good attorney in NY NY..
if you got some Attorney , I would take the Tel number ..
Ho long will takes to wait for supreme court , just to by some time till amnesty takes over .. everybody is saying that.
evreything would be good if I wasnot cheap first time ....I sopposed to hire good attornie and would be over long time ago.

Cutting to the chase, do you know before which agency is the matter pending now? Yes or no??? The BIA, the second circuit (panel), the second circuit (en banc) or the Supreme Court (on a cert. petition)??????

And on what basis will the Office of Immigration Litigation "settle" the matter if they have been winning across the board?

There is no chase here.............. After IJ denied my case " Plitical Asylum " Other attorney filed to BIA (board of appeal).. I was denied , than different attorney (the present ) filed to federal court, motion to reopen , wich was denied, than he said to me that last thursday he tryed to settle the case..(cause the IJ was not fer and did not give me chanse to present the case I was interupred all trial lasted round 15 minuts). but he did not yet resieved answer. ...........He think the case will be denied, and he have 30-60 days to file for Supeome court to second sircuit.
I am going in Friday to see other attorney wich is very good and top noch :rolleyes: $$ ... he will explain to mee what is going on cause i cant get nothing from him only "do you got money $10.000.00 ..

Well , do you guys think getting married will help ?? I am being told it will be dam complicated, will have to start all over again and investigation would be hard and last forever.

What you heard is right. All the internal fraud red flags will be up.

So , you think this attorney dos not make a sense ?
What would you advice me , what should i ask this present attorney and ,
and generaly what should I do , I believe this is like throing money in garbage.
To day I got appointment with some other , attorney , actualy I dont know how to tallk with tham and what to ask.
Thankful ! I do appreciate your consern, I do feel alon in this beautifull world just dont know whay I am going through this , and I reraly deserv political asylum.
 
Well I just finde out that my case pending in second sircuit in federal court.
He is no longer my attorney. I( must finde differents one .
wantmygrncardnow I think you are right . I diont think is worth spending money in something that will not work for shore.
Now Iam clueles , and have no friking idea what to do
 
get married, then prove to the INS its legitimate marriage,

i hope there are other easy options,

i really hope you get your green card, you went through a lot of pain
