same state, different processing time for different cases??!!

I found a very strange thing:
In NJ, the labor department processing time is 4/2001 and 12/2001 for regular and RIR. But I found there were both RIR and non-RIR cases received by the state level in 2003 were certified. There are lots of those cases. Most of them are for University faculty positions, but there are also IT positions for consultanting companies.

It is very strange to me. Does anyone know the reason?

It is happening with almost all SESA/DOL I guess, at least it is common with Atlanta DOL. You can't really predict the process behind it. Just in hang in there and wait.
 
There is a process called limited review, wherein DOL usually ceritifies the applications immediately upon receipt from SESA. SESA needs to tag the case as being of limited review category.

It happens all the time. Universities get priority treatment by DOL and get LC's processed in a couple of weeks in many states.

In California, if you are a circus performer DOL will do your LC in six months (see below for a link). Basically, DOL appear to be making a value judgment on the type of employment to see how quick they will process it. I am sure people in Hollywood get similar treatment as well.

It's extremely inequitable and could easily be the basis for a lawsuit. All LC's should be First In First Out, and they shouldn't give priority to movie stars, models and circus performers, nor to academics.

If DOL doesn't get these backlog processing centers online this year and sort this mess out, I'm sure they will get sued by me, if nobody else.

I don't think we can

always explain the reasons as Limited Review or Special Handling (Univ.) cases.

As one user name says, this a mockery of the system. Look at Atalanta DOL, apparently they have couple of people sitting at GA SESA office, and certify all the cases that go through SESA process immediately (PD in Nov, Dec 2003 for example) while at the same time people with DOL receipt date of Jan, Feb 2003 (PD most likely in 2001 or 2002) are still waiting for the approval.

and you can see this trend yourself.

If such difference is a month or two no one cares... but...

someone filed in 2001 and still waiting and some guys are luck though that their labors have been cleared evnthough they filed in 2003.

there have to be like First in First out.eventhough they are important they have to check first 2001 cases. we are paying taxes and everything and we are completing their work also on time.

All regional DOL seems to have come up with the new technique
called 'Shit In Shit Out'. FIFO and LIFO technique seems to be obsolete now days.

Why should we go through this hurdle like?
LC-> I-140 -> I-485 to get GC. In my perspective, we are the one
should our GC first not the illegal immigrants.

It is driving me insane. We have to wait >2 years for LC (mine is non-RIR) then several more years for I140 and I485.

It is UNFAIR and DISCRIMINATION that DOL is giving LC's out at random. Like PradK said, it wouldn't matter if it was a month or two, but for some academic to get their LC in two weeks while I wait two years is UNACCEPTABLE!

My boss wants to ring up the local SESA and DOL and give them an earful. Their incompetence is hurting his business and it is ruining my life because of the uncertainty.

How can any government department justify having a backlog of years!? You would never see that at the IRS of course!

yes exactly AwardMyGC, your right, its very bad you see, so many illegals applied and they are getting in front of us, eventhough they didnt pay any taxes, they worked illegally and get amount without tax,send to their homes .....

i am not angry with illegals, i just want our cases also have to take care on time, why Universities people will get labor early??
why not us, they are doing illegals also ahead of us

we are in RIR EB2 and waited more than 2 1/2 years.

Let us know what DOL will have to say when your boss calls them. We are also working on some thing similar for Atlanta DOL. Can't say now if it works out or not, but we are trying have our director call them. Our Attorney already sent them a fax some time back but no reply so far!

DOL definitely cannot legally descriminate cases based on the state or based on types of cases though special handling/limited review is a different issue. I am not sure, what excuses
Mr. Goodman (with bad plans) will come up with!

It is true, but very lengthy process. My lawyer/employer will not help, and I will definitely loose my job, so avoiding. Otherise, I wish it could happen.
