What about heterosexual couples who can't have kids but instead choose artificial insemination, should it be out of the question for them to?
The whole argument about natural procreation and what is "normal" no longer seems valid with the introduction of genetics in the picture. Evolution has defined procreation, and human intervention has redefined it. Who knows where we will be in 100 years...

In my opinion one has to fill the application to the best of his or her knowledge. Everyone need not know all the federal and state laws in all the different areas. To the best of OP's knowledge he is "married" since he followed the due process of marriage in his state and has the certificate to prove it. Is it necessary that one reviews all the federal laws before filling each question in the form? I agree that putting "single" may not matter after all in the end, but IMHO it may be more appropriate to put "married" so that the question of immorality in concealing the status doesn't arise at all (unless the IO is "Al" in which case OP may be denied due to immorality of the act ).

Also I don't think they ask for the sex of the spouse on the N-400; so there is a good chance that the IO may not even notice that it is a gay marriage.

Just like the US govt, I don't recognize same sex marriage. It is unnatural for two men or women to be together, let alone share a bed. This isn't a question of bigotry or hatred, of natural laws as we found them set on stone when we born into this world. Whatever the CA Supreme Court decided, it is irrelevant to the federal law...

Cheney's daughter can have as many kids as she would like, the fact remains gays and lesbian won't procreate on their own, cause it is unnatural...

I thought I was exercising my 1st Amendment right... I didn't know that choosing to disavow this homosexual stuff is inflammatory, I beg to differ.
I was Israel not a long time ago, ran into a rabbi who claimed he was gay. It sounded like asking the Rabbi of Jerusalem to serve pork feet on hannukah...

This is not a public square but a place for people to exchange information about immigration procedures and get help and advice on immigration matters. If you want to be a troll, you should take it somewhere else. Plenty of places on the internet for that.

Al Southner, I understand about the 1st Amendment, but you need to understand that it is a choice and we are all humans. Just don't disrespect others. You can exercise your 1st Amendment but be courteous!

I am a liberal as they come, and I just decided to throw a flame into this discussion to see where people are. I suspected my views on this issue would cause a stir. Given that I see how people can be intolerant to differing views, I am not surprised.

My view on this issue are: gay people can get married, as long they aren't allowed to divorce.. I don't see gay marriage as a threat to traditional marriages, but an incentive for heterosexual couple to stay together or BOB over there might steal your husband...or Suzie over there might take your wife. Gays should be allowed to marry, so they experience the hardship called marriage. However, given the strength of the conservative moment on social issues, liberals won't prevail on this issue for at least 30 years. In the meantime, gays and lesbian should relax and stop trying to force issues. We need to pass health care reform first, punish the bankers, retain strong majorities on both houses of Congress, create more jobs, withdraw from Iraq and stop Iran's nuclear program which will weaken the GOP even further, re-elect Obama in 2012, and then he can feel free to add gay marriage to issue before Congress..

Great, a self-admitted troll. I don't care if you are liberal or conservative or if you are pro or con same-sex marriage. If you want to be a troll and a jerk, fine, but please do it somewhere else. People come here for practical advice and exchange of information on immigration matters, not for inflamed political debates. I agree Al's first comment was very jarring, but I would still not censor it, 1st amendment or not.

Now turn your sensibilities 180 degrees. How will these comments sound to you? Or to a person who is actually on the other side of the fence, but still will apply law as written despite his/her feeligns. Why are we pre-judging the other side? Anyway, the point is that lot of what is said here is legal only in a subjective way.
