This is for my friend.
He is on B1(Vistor visa) and his B1 Visa expires on Jul 2005.
My ??s are as below

1. Can he apply for B1 Extension and also simulateously apply for H1-B under the current/next year Quota??

2. If he applies for H1-B and gets approved, can he continue to stay or go out of country?? and also can he start working immi., after applying for
H1-B or wait till Oct to start working??

3. He does not have a Masters from USA and is he elgible to apply under the additional 20,000 H1-B visa that INS has craeted now.

4. also advise which one would be safe, to apply B1 Xtension and then apply for H1-B visa or no need to wait , directly apply for H1-B Visa.

Please advise.

Most of the time new H1 will be approved for B1 holder, he has to go out and come back and start working from Oct 1, 2005 only.3. He does not have a Masters from USA and is he elgible to apply under the additional 20,000 H1-B visa that INS has craeted now. You have to watch the rule it is keep changing.
4. also advise which one would be safe, to apply B1 Xtension and then apply for H1-B visa or no need to wait , directly apply for H1-B Visa.
Both can go together. B1 xtn you are the petitioner. H1 your employer is the petitioner.
Please advise.

URGENT - B1 to H1

Hi Great Guru,

I have found a person who is ready to sponser my H1. Its a very famous Tax and Accoutning Firm in Calirfornia. I have here in USA on B1/B2 Visa. I hold a multiple entry 10 yr visa. My question :

My I-94 is valid upto 18th October. I plan to go to India and then come back. Is it recommendable to do that. My gross pay here is only 24K p.a. since this is the beginning. They wanna see my work and then promote me. Will this be a hurdle for my H1 stamping in India? The firm hasnt had a history of rejections before.

I have to give documents by tomorrow as current years quotas r finishing soon. I have to tell them whether to apply for conversion of visa or overseas application. Please advise ASAP.

Another query - If I take the job how soon can I transfer the H1 if I have another employer to give me a job?

it is too low in CA for a H1 visa. I know even CPA get less than 40K in CA.
Atleast in the offer letter ask them to put atleast 36K to get visa. Rejection may be less.

Once first H1 is approved and you are in side US, you can transfer the same day.

First get one H1.

Thank You Great Guru for the response. However, my query still remains. I am sorry for not putting it straight the very 1st time.

My details are as under in short :

- I am here on B1/B2 Visa (10 Year Multiple Entry)
- My I-94 is valid until 18th Oct 2005.
- I am taking the CPA exams. Have not yet got the qualification.
- My employer is filing for a change of status from B1 to H1.
- Salary offered (ONLY) 24K on an annualized basis - ORANGE COUNTY, CA.

My queries :

1. Is it more likely that I will get the change in status? In other words, is a status change more easily obtained than a visa stamping in home country?

2. I feel that even though my status change will be approved, my I-94 will be as per the original date. Is this true that in most cases they don't extend the I-94 date?

3. If they dont then that will mean I have to go to India and get the stamping from Mumbai and getting a stamp from there for a salary under 40K is highly impossible. What do u think about this?

It is very hard to live in OC with 24K. Even a studio will cost 800$ per month.
Unless you stay with your relatives, living is not possible.

Prevailing wage for Level one in OC for an accountant is $38, 626. with job code 13-2011-01.

First of all how they are goig to get H1 with 24K?

I have some queries regarding the conversion.

1.I am working in india in an mnc company. Recently i came to usa on b1 visa in July ,2005(company has send for training sessions).This is my first visit to usa .My I-94 is valid till oct 29th.
Prior to that in April,2005 i have applied for fresh h1b(whille in india).
Since then Waiting for h1 when it will be approved.Recently in Aug 20,2005 my h1 got approved.

Now , below quereis.

1.Whether i will get h1 approval papers with I-94 at the bottom or not ?

2.If i got I-94 , then can i change the status from b1 to h1 ?

3.if i did't get i-94 in the h1 approval docs, then i have to leave in oct' ending and go back to india ,
do stamping at chennai consulate and come back to usa on h1.

Is that is the procedure or any other procedure is there. please clarify me.?

4. While applying for h1, i did't apply for my spouse and kid.
Now while stamping for h1 for myself, can i apply for h4 (for spouse).

You will not get your I 94 at the bottom and start working you must get your H1 stamped in your pp and enter with H1 visa to get I 94 with caveat h1b to get your Social Security Number.
2.If i got I-94 , then can i change the status from b1 to h1 ? You will not get I 94 at all.
3.if i did't get i-94 in the h1 approval docs, then i have to leave in oct' ending and go back to india , YESdo stamping at chennai consulate and come back to usa on h1.
