RFE from VSC

It was TSC to VSC

I guess there is alot of information that they need to receive and they wanted to get going with the RFE process as soon as possible.
I noticed your PD and RD information, you should hear soon! The wind has been taken out of my sails abit that\'s for sure.
 
Nothing special in it..but the other way of saying \'GOOD LUCK\'..

Even my case dates are the same as yours. If I ever get a RFE, I wanted it to be a simple one to be solved without any hassles & I wish the same for anyone who receives a RFE.

Question about EB2/EB3

If for some reason, an EB2 case gets an RFE at the I-140 stage due to educational qualifications, will the case get moved to EB3, or does it get rejected? If it gets rejected, does the person have to start all over again, applying for labor etc?
 
EB2 or EB3 depends on the labor certification

It should be set at the beginning when your company file for labor certificaiton with the job requirements/qualification - if you are using substitute labor, it is still the DOL\'s decision not INS.

It can not be changed to EB3 once certified.

My case sleeping in INS hands strangely. AVM says they received reply
to the RFE on 15-Apr-2002 and it takes 240 days to process this kind
of case. Does anyone in similar situation?

employer filed bankruptcy protection - will it impact I-140?

Hi,

My employer filed for bankruptcy protection. Though I am not sure
what is in RFE, will it impact my I-140 application. The reason
I am asking this question is because of overdelay in approving my
case.
