RFE !!!Desperately help needed .

hello all..

I was working for Company 'X' who filed my Green card . I passed, Labour, and I-140. Later, i filed for 485. 6 months after filing 485, i got an offer from another company 'Y', and i took that offer.

My current company pays me $4000 less than what it was stated in Labour when i filed it with my previous company.

There is an RFE from INS asking for Paystubs, W2, tax returns and Employement letter.

I have everything that INS is asking for. but my Attorney says that since my current pay is $4000 less than what it was on Labour, my chances are Slim.

Any anone been in this situation or are there any suggestions ?...
Please let me know.

you don't have a choice but to give your current emp letter...i don't think BCIS will create an issue....so relax:)
 
What is BCIS ?....

my attorney says $ 4000 less is going to be a problem.

So what should i tell him ?..

If your work description matches with the current one then you are all fine.

Your lawyer is misleading you.

I guess it might not be a problem if it is substantiated with valid reason. I hope u read some of today's postings where in one of the guy with AC21 got his approval inspite of his salary differences.
 
your attorney is full of shit - check out phaedrus_1's post today. $4K is pretty insignificant. BCIS is INS (longer acronym, just as bad). you will be fine.
 
Your lawyer is incompetent. He is afraid of INS (BCIS). He can't fight them even if there is a minor issue. But it may cost you more money to change lawyer just for replying an RFE. Go ahead and submit the details and relax. Ignore what your timid lawyer told you.
 
You need a new(better) lawyer read the posts mentioned above and dig into murthy.com

You are all set. Just dont worry about the $4K / year ...
There are many who have 20-40% less salary and have been approved.

Before i joined my current employer, my previous employer was not paying me even 1/3rd of the pay during Bench time.

Now i joined new compmany who are paying $4000 less than the Labour.

What should i tell my attorney or advice him on putting it on Cover letter ?...

Nothing. Submit the letter as is.

If BCIS has a problem, they will give you an RFE or an Intent to Deny notice. At which point, replace your attorney and get a real one.
 
Don't worry you'll be fine.

Need not tell anything to the attorney. Just get the employment letter with your present salary and ask him to reply the RFE with other documents. Don't mind your attorneys words about your chances. Ask him to visit these forums so that he'll get some experience and won't scare his clients. Don't even think of $4000 difference. You'll be fine.

Find a competent lawyer IMMEDIATELY and respond to your RFE. You should be approved shortly. Your current lawyer appears to be incompetent and stubborn. The adjudicating officers understand that in this kind of an economy salaries are bound to go down, so they will approve your case even if your current salary is $4K less than your LC salary. Be confident. Best of Luck.

Fire the lawyer. NOW. Spend the weekend looking for a good immigration attorney. Ask around here.

On Monday, call their office. You'll need to fill out a new G-28 form for your new attorney and you will be done. Life is good, don't worry.
 
File G-28 and appoint another lawyer. Your new lawyer will send a notice to previous lawyer asking for ur file. Lawyers are acutally pretty good in communication with the other lawyers.
 
Also, when i changed my jobs, i didnot inform INS about it.

Will this be another major problem while responding to RFE ?

Here is the small clue given by my Lawyer at this situation, In the employment letter ask your employer to mention Salary plus with other corporate benefits, hope this will cover your $4000 . Explain your Lawyer that you are getting more than what was mention in the labor in the form of benefits.
