RFE but Rediculous..no clue

hey all..
as i said before i was gonna receive rfe...which i did today. It asks me by birth certificate AGAINNNNNN???which i think is ridiculous. Coz i am prety sure i sent them with application. WEll, in my country the hospitals dont issue BC, so i made it through embasssy...
so what do u guess suggest me?should i try a letter mentioning this to them?and resend the same document as rfe again? thanks
 
Hm, does this document from the embassy say "birth certificate" anywhere? And is it in English or in your native language?
 
yes patty,

The document from embassy clearly says "BIRTH CERTIFICATE" on the top center. and its on all english (no native language at all)...
i am thinking of writing a letter saying that they dont issue birth certificates there, this is the reason why i got this document. does anyone have same experience? please suggest!
 
Livelife, I think that it is the problem: the document is in English. I know it doesn't say in the instructions that it should be in your native language, but it happened to running_swede too. He sent an English version of his birth certificate and got an RFE.

I would suggest you do two things:
1. Call the service number to find out what they think is wrong with your birth certificate. Maybe you are lucky and get someone knowledgable on the line. Please let us know if you find out. If you don't find out:

2. Call your embassy and ask for a version of your birth certificate in your native language. Then send both versions along with a certification of yours stating that the English version is an accurate translation.

They find fault with a lot of birth certificates, believe me. I can't think of anything else that could be wrong with your birth certificate. Maybe they only consider it believable if they have one in your native language.
 
Is your native language English? If not, then perhaps they want the document in your native language. I got the same RFE as you, although I had included my country's equivalent of a birth certificate in English with my I-485. I am planning to send the same document, but in my native language, in response to the RFE. I will include a copy of the English version and I will certify that the English document is an accurate translation of the one in my native language. That is my plan. They should know at USCIS about the requirements from different countries. I talked with a lawyer before submitting my application, and she knew what kind of information I needed (I was just stupid not to pay attention when her paralegal told me I should probably have it in my native language, hence my RFE).

BTW, your parents' names are on your document, right? In my country, there are different versions, and I was told to get one with my parents' names on it.

I think it really should be on the instructions that they want one in your native language. All they say is that you have to submit it with a translation, so obviously it seems to be convenient to just get an English version.
But don't worry guys, these days RFEs don't seem to delay your case so much at all.

actually my native language is not english. i do have 2 BC documents, one from home country , it has my native language written in headings (name of town office, place) etc,, but the letter it self is in english, doest it have to be in native language?but i ddint send that one.
i sent the one i got from here embassy all english version including headings and all. so should i send them both??
 
I think the USCIS is looking for the one you have from your home country. In their eyes, that would look more valid than one you got from the embassy. But then again, their instructions say that you should have the BC, and a translation if it is not in English. So try sending copies of both of them to the USCIS. That should work. Good luck!
 
Hmmmm! That's interesting... I didn't know that any such requirement (the bc should be in the native lang) existed. In fact, my husband couldn't find his original bc, so he had to ask his folks back at home to get a new one issued which they did. The new BC (as they do now) is entirely in English, but we didn't get any RFE for that. In fact, what they did while reissuing his bc was to put the Registration Date same as the Issue Date (ie both dates are XX Feb 2006), which is kind of making us nervous for the interview. Because logically thinking, even if you get a bc reissued, the registration date should still be the original date on which the birth got registered.

Oh well... he's getting affidavits from his parents confirming his date of birth and then obviously he has his passport and his college certificate with same dob... so hopefully we'd be fine.

Anyway, I don't really think that the RFE that livelife got is because of the BC not being in the native lang... I think its because USCIS does not accept BC issued by the embassy. If I am not mistaken, I did read someone stating this constraint from USCIS - best to call them or get an infopass appointment to get the reason and possibly a solution to the problem.

i just called customer serv. they suggested me to make info pass appt. which i dont think i ll. after wating 35 mins finally got to speak with a lady with a southern accent, she was only reading info from her computer which i could tell. so i just kinda ended the conversation and thanked her for nothing.
well , now what i am planning to do is, send both BC , one from home town( header is in native lanaguage) and the letter itself is in english, and one from embassy, and hopefully they will accept. I should have sent both before , the reason why i didnt was coz', ithought they wanted every single words in english.
lets see what happens..

This does not explain my RFE because my "birth certificate" was issued by the Swedish Tax Agency. They are the official keepers of the population register in Sweden. It could not have been from a more official source. I am hoping that the Swedish version will do, but perhaps I should get an InfoPass appointment anyway.

Hm, a_usc now left me really clueless. :confused:
Running_Swede, if the agency is the problem then maybe you should include a letter stating that the Swedish Tax Agency are the official keepers of the Swedish birth registration.
In any case, I guess an Infopass would be a good idea. Better to know what they want than to get another RFE.

Livelife, you said that the other BC still had some words in the native language. I would make sure that you translate these, even though the rest is in English.
 
I have an InfoPass appointment on Monday morning, so I will try to get some clarity on this issue. Calling the customer service number is useless. As livelife said, they only read information from a computer screen. I do not understand why they need humans for that job. First they ask you the same questions you already answered by navigating the menu system. Then they just read a generic response. And I waited 30 minutes for that!?! They should just have a computer read the answers.

Totally agree. Or hire people that have been through the Immigration process themselves.

does it have to be 2 weeks in advance to make an info pass appt.?
or we can do that in less than that?anyone please??
 
Sometimes, getting an infopass appointment could be tough as they have only limited spots and all of them maybe taken. So you will have to keep trying until someone cancels or more slots are open. You can setup an appointment for any time after today (the current day). Good luck!
 
It was really easy for me. I think the Pittsburgh DO is not very busy. Not so many immigrants around here as in other places perhaps. I got an appointment first thing Monday morning, but it seemed like there were appointments available at any time next week.

As per the visa reciporocity schedule, USCIS recognizes that birth certificates in Sweden are issued by the local office of Swedish Tax Administration (Skatteforvaltningen)

hello all,
i have a BC from my homecountry. But the main Header is in my native language that basically says the name of the town, and underneath there is in english (smaller font)... also on the side , date, registration #(its in native language too)...the whole letter is in english though. do i still need a translation? anyone please?
 
I will suggest that you should still send both BC in your language & English.
