RFE, but I am working for a different company

Hello,

I started working for a company A (H1B) back in Mar.2002 in Sep 2002 they got approval for my labor certification and in Oct.2002 failed 140 and 485 for me (including request for EAD).
The thing is that at that moment (from Aug.2002) I've been working for a different company (B) (H1B). This was reflected in the documents (140 and 485). In 2003 I’ve received EAD and continued working for company B.
Now in Jan.2004 I left company B and joined company C (no H1B I’ve used my EAD), but I did not notify INS about that.
In all three companies I had similar job title:
A - Software Developer
B - Senior Software Developer
C - Senior Software Developer
I talked to my lower about notifying INS, but they told me that there is no need to do that.
Now today I’ve received RFE request (employment verification).

Is my situation bad?
Had anybody a similar situation?

Just do what they ask - give them employment verification. State your salary and date of hire. Maybe your lawyer can write up a good EVL.
I've heard of much worse cases than yours, so don't worry.

I am wondering how comes that a good latter can change anything? Does not INS make decisions based on strict rules? Can they go against rule if latter is that good?
 
When I went to the interview, the lawyer made a letter in such a way that it strictly complied with my labor cert. Usually it does not matter, but my lawyer told me that it's always better for the letter to match exactly so you get as little extra questions as possible.
 
INS is staffed by monkeys who only compare things and don't derive conclusions. So if there is anything even slightly different from what they think you should have, they will create a fuss. The best way to tackle the problem is to be smart and not let there be a problem. Having said that, your lawyer is probably the best person to inform you how the EVL should proceed based upon your LC.
