RFE: Birth Certi

Hello,

I got an RFE for Birth Certificate[bc]. My bc is lost and dont have it. I sent letter mentioning the same and that local municipal office has no records of my bc. Sent affidavits from both of my parents. Still I got an RFE.

The reason seems to be that I did not submit letter from goverment mentioning that they dont have my bc record. What are my options?

Can I get a passport based bc from Indian consulate office here? Is it considered a valid proof of birth?

What are my options?
--------------------Get the non-availability Certificate of birth record from the municipality and send them copy. If you get the non-availability Certificate in Indian language then get it translated by Notary on stamp paper and send them copy of non-availability Certificate AND Copy of translated non-availability Certificate.
Can I get a passport based bc from Indian consulate office here?

if you dont have a BC then you will have to get a non-availability certificate from you birth country. Affivedit alone is not enough.

I had the exact same issue during my GC process and had to make a trip to India to my place of birth to get the non-avail cert. it was a pain becaue it takes a long time to get but i only had two days. needless to say i had to pull some strings to make it happen.

you will have issues even later on in the citizenship process if you dont have it because a birth cert is needed there also.
