RFE After Interview --Please Advise

I had my interview three weeks back and got a standard letter 'decsion cant be made' because two weeks short of five yrs...bit then was issued a RFE to send my marriage certificate. I sent it two weeks back but there is no confirmation if they got it or not. I sent it by snail mail --USPS-- certified with return receipt but they are not able to track it or confirm it if it reached there or not, and I havent got the return reciept back too.... Now i am worried, that possibly they havent got it..they gave me upto Feb. 5th to reply to the rfe ;; What can I do? Is there a number I could call USCIS to see if they got the copy of the certifcate..I should have sent it bey Fedex but wasnt able to do it at that time and sent by USPS...I just dont want to go past the deadline..could you please advise.

Why did they need your marriage certificate if your is 5 years based? Did you get your GC thru this marriage?

You can call 1-800-375-5283. Choose option 1-2-3 to talk to a customer representative. Request customer representative to transfer your call to an immigration office
(not customer representative's supervior or their manager but to an IO).

If you don't want to save money on gas, parking depreciation of your car, make an inopass with your local DO that did your interview

And if you do want to make an infopass which I strongly suggest , make one before your deadline and bring the documents in case they don't receive it. In fact,
I remmeber I saw an instructlion slogan in the USCIS DO that says all document submissionn must be done thru an infopass appointment.
Maybe I saw it wrong or it is only in the USCIS office which I went to

As in my wife's case, an IO can ask for marriage certificate even if the application or GC is not marriage based.

It is strange because they don't ask most of time so it is not really required but they sent a RFE wriiten notice to the OP. If I were the IO, I might ask to see it during the interview.
But if I already skipped that during the interviww I would probably not still bother to send a written request unless I have a strong reason.

Maybe the IO did ask for it at interview, but the OP did not have it. The OP will need to clarify that.
As for a requirement, an IO can make any document a requirement to adjudicate a case even if it isn't asked for most of the time.
My guess is that marriage certificate can be a required document to double or triple check applicant's ID or to corroborate the applicant's story.
 
Just send another one by certified mail immediately and also take an infopass appointment, tell them you got the RFE and you already sent the marriage certificate but you suspect that it was not delievered and you came to deliver it personally. If necessary, request to talk to a supervisor and give it to him/her. Note the name of the officer you gave the certificate. In case if they deny your case because of no response to RFE, you can dispute it with evidence like Infopass, date, time and the officer you spoke to etc.....

Before you resend it make sure your A number on the RFE matches your actual A number. They screwed my A numbers up and misfiled some of my paperwork.
 
Thanks for all your response...my GC is employment based. I had my marriage certificate with me when I went for interview, but the IO never asked for it. The USCIS office is 150 miles from here and it took me five hrs to get there for interview because of the snow. I will try to call them on Friday and if I cant get through to an Immigration officer, then I will just send one by Fedex so atleast it wil be there by the deadline. But I am surprised, why I O didnt ask for it during an interview and send me a RFE on the date of teh interview to submit the marriage certificate.

One more question-- do I send it to the attention of IO or just to USCIS??

Was there anything else that came up at interview to make IO question case or was IO unpleasant?

You can send request either to USCIS or IO ..either way it will get attached to your case file.

How about both? You don't have to save 10 bucks so you can fedex both the IO and USCIS. On you N652 from, the box is checked to
instruct to send inquires ect to the IO who interview you. The IO's name is on the N652 form

If it came from the IO directly, send reponse to IO. If the RFE came from USCIS, then repond to USCIS. Also, stop thinking about why the IO didn't ask for it during the interview. It's past now. Focus on what needs to be done to clear the RFE issue. I still suggest you mail it once again and also hand deliver it personally. This is a once in a life time thing now. You finish that oath and you don't need to worry about immigration issues ever again, unless you loose the naturalization certificate.

If the doc is sent to the IO but this IO need to take vacation, will he arrange the doc be passed to another IO who
take his place?
 
My RFE came from IO and I will send the marriage certificate again by Fedex tomorrow...dont trust USPS anymore, this is the second time they lost my package-- the IO didnt ask about marriage certificate at the interview, she was very polite and told me based on the evidence that she sees, it will be approved; not sure why alll of a sudden she asked for it. I just want to see if they look at the information from secondary inspection; because I told them last time I entered us that i got married; but didnt have any marriage certificate or any papers...so I had to marry again, when my wife came here; and i presented the new date -- but if this was the case she should have asked the question at interview --- I am just concerned i hope they wont reject based on the marriage date-- i talked to lawyer long time back and she told me not to worry about this; and use the date when i was married here, my wife is a student and i havent filed for her because i was waiting for my naturalization.

Every application is double checked by another IO. Perhaps the secondary IO wanted to make sure you remarried your same wife instead of remarrying another wife and committing polygamy.

They will have that system in place already. In general, an IO is assigned to a particualr case and only that IO will decide the case. Then it goes to the supervisor for review. In cases where the IO goes on long vacation, the supervisors re-assign the case to someone else. So they have proper procedures in place.
