Returning to home country while waiting for visa number to be current

Hi everyone,

My mother, a former Japanese national, now is a U.S citizen. She filed I-130 which was approved in July 2007. I had H-1B visa back then and now, after attempting to change to F-1 per my attorney's advice was denied, I'm returning to my home country.

Now that I'm going to Japan, do I need to notify NVC or USCIS that I am leaving U.S? Who do they contact once the visa number is current? (interestingly the site for U.S. embassy of Japan doesn't mention the "once visa number is current..." but rather "once I-130 is approved...")

I contacted U.S. embassy in Tokyo and was told they will notify the agent specified in DS-3032, which I haven't filed for (I thought I can't file it until priority date is current), for the next step.

You need to ensure that NVC has your correct overseas address. With regards to your departure from the US, submit your I-94 on the way out.

I called NVC, but they do not have my case established there yet. My I-130 approval notice said the CSC is holding the file until PD is current...

Should I still contact NVC or CSC?

No point contacting anywhere that doesn't have your file. I suggest you write to CSC and include your case number if possible.
 
I'd have to check with my attorney who filed my I-130. She didn't tell me any detail on that upon filing. But I'd assume AOS since I was on H-1B at the time of filing.

Update:

It was filed as AOS. So now I'm filing I-824 and once it's approved, my case will be sent to NVC, then to Japanese consulate.
