Retrogression is started!!!

They are either mistaken, or USCIS denied the petition in error.
It seems like that retrogression is already started.
Since the numbers for all EB categories are current for November 2004, it is impossible for any I-485 to be denied for this basis. The numbers for December 2004 are out as well, and all appear current.
Going forward, retrogression should not affect anyone with a filed I-485; it can only affect folks in EB3 born in India, China or (maybe) the Philippines who have yet to file an I-485 and whose LC was in early 2002.

All, his 485 denial was not bcos of retrogression, it is bcos of his 140 denied... company provided document was incorrect or wrong...
retrogression will be starting only from Jan'05..
