Residency Requirement

I recently asked about applying for citizenship and got some really great information. Ultimately, the conclusion was that I am not eligible to apply until August 2011.

The problem is, at the beginning of August, I will be moving to a new state to start a new job for one year. Since you need to live in the district where you are applying for three months prior to the application (correct me if I'm wrong on this), does this really mean that I actually can't apply until Nov 2011? Is there any way to get around this?

Keep your address where you are living now as your move is temporary, keep your DL, Utility bills at your current address as proof of your domicile to file your N-400 in that district.

But then wouldn't I have to come back to this district for the interview? I am not returning to this address once I finish that job--I will be moving somewhere new.

I think the only way to get around this is what namecheckvictim suggested by keeping your old address. But if you can't make it back for the FP, interview, and oath, then yes, you'll have to wait until Nov 2011.

Yes, you will have to come back to this district, another option is to maintain your next residence up until you complete the process after you apply.

Can you afford to move in advance of the job start date? OR secure an address there in advance? Otherwise, just wait it out.

This is what you can do. Let us say you live in Idaho, in the city of Potato. However, you are moving to Iowa, in the city of Sweet Potato on August 31, 2010. If possible, you can retain your address in Idaho, in the city of Potato from from August 2010 till August 2011, while you physically live in Sweet Potato, Iowa. When you move back to Idaho, but move to the city of Pumpkin, in August 2011, then you still quality for residency and you can immediately apply for citizenship without having to wait another 90 days.

So there is no way to get your file "transferred" to a different district?

To clear up some of what I wrote before, here is the actual situation: my parents live in CA, and that is where my permanent address is. I have been going to school in NY for a few years. I can prove that I "live" in both places--my driver's license and a lot of my mail goes to CA, but I also pay rent/have utilities, etc. in NY. In August, I am moving to TN for one year. Maintaining my residence in NY while I'm in TN is not possible, since I presume I would have to keep paying rent for months until the entire application is approved. Also, I will not be returning to this part of NY once I finish my job in TN. Maintaining residence in CA is possible, since my parents are there and all I would have to do is not change my driver's license, but having to fly back to CA for fingerprints/interview is not. Plus, and this is only a secondary consideration, but because they live in a large city I imagine the wait times will be much longer than in TN. Is it not possible to start the process in CA and then in November have the file "transferred" to my new district (in TN)?

Thank you for your help everyone.

You did not say you were a student, in that case, look at 8 CFR 316.5(b)(2) and see if you qualify under that for the initial filing. Transfer is possible after that.

I do qualify under (b)(2)(i) and (ii). I don't think (i) will help me because I graduate in May 2010 and am only eligible in Aug 2010. Can I use (ii) to apply in August 2010 and then to transfer to TN?
